Jeff is absolutely correct. We HAVE TO KEEP FIGHTING these mandates. My husband is a federal contractor. His employer pushed VERY hard to get all employees to take the jab. Told them if they weren't fully vaxxed by "x date" they would be fired. Many pushed back. They have several locations across the US...and the employees organized and communicated thru Telegram. This enabled them to share info and gave them a support network. Many refused to enter their vax status in the company's tracking program. His company was in a corner because they would lose a lot of people if they fired the unvaxxed....and that could affect their federal contracts.

Even when the mandate was stayed, his company did not notify the employees. In fact, they continued pushing the vaccine. Employees pushed back and demanded they put out a statement....which they finally did. In the meantime, they have added a covid jab requirement in their handbook which applies to new hires. Many employees have quit for other pastures and they are having difficulty filling some of their positions.

But this crap isn't over. It will once again rear it's ugly head.

Also, the CMS mandate for Healthcare workers needs to end now!!!

yes my company went along with it, they have "suspended" it for now but left the language if it is not overturned they will pick it back up again. Get a religious exemption if possible

I was fired from my job of 7 years for refusing the vax, and submitting an exemption for the testing and masking. I am now fighting a battle with them through the EEOC. I was the only one out of over 300 employees to fight.

I'm not a big Peggy Hall fan, but about 10 days after I was fired I was offered a job by an attorney as his administrative assistant. He's an attorney in Ohio who is fighting the mandates throughout our state.

My company wanted us to enter our vax status as well. You could put “Yes”, “No”or choose “to keep info private”. Then, down at the bottom a disclaimer said if you chose to keep it private, they would mark you as a NO anyway 🙄

I visit a care home resident regularly. Every time I have to fill out a 2 page health form. 🙄. I always leave the vax status and request to put even the dates of jabs and brand totally blank. So far no questions. I do mask and would not visit if I had any hint I was sick—like we always did. I haven’t worn masks anywhere else—since last summer. Walmart last week only had a few in masks. I don’t count the teens because there is something else going on there, sadly.

First, we have canceled Disney in this house!!

Second, Federal VA worker here… I need to point out there is a difference in filing you’re religious exemption and having your exemption accommodated. Currently the VA is in process of removing all religious exemption employees from “patient facing” jobs. After two years of working with COVID in our lives, all of the sudden they can not accommodate religious exemptions. So, many of us are on the brink of loosing our jobs. We are fighting it!! Even wrote to Mr Childers hoping he would add the story to his daily posts. He did not. But we are still fighting it!! Pray for us!!

DoD employee of 42+ years here. If my agency doesn't approve the REs, which I presume they can now "adjudicate" (by 1 senior person who has vociferously posted his disdain for those who did not get the shots), we would have to go for 5 days of "counseling" with ER and then be put on 10 days of "unpaid leave" and then - we would be canned. Of course if we "see the light" and get the shots, all disciplinary actions will stop. Or so they say. Very few people have confidence in our leadership anymore.

Secretary Denis McDonough is attempting to drastically change the VA healthcare system. It’s so sad. He will privatize some of it soo companies will be incentivized to not give as thorough of care because it will cut into their profits.

Plus he started this process on removing us weeks ago. Before the court lifted the stay… he is ruining the VA healthcare system!!

*The lawyers expected this result. They are ready to file an en banc appeal. They are actually happy with the result. It was fairly straightforward and easy to argue against.

*The 5th circuit ruling is not on the merits of the case. It essentially says the 5th circuit does not have the authority to put an injunction against the mandate. It does nothing to establish precedent on the case.

*The DOJ knows we will file an en banc request. Therefore, they will likely not act until the 5th circuit decides to accept or reject the en banc appeal (all 17 judges issue a ruling instead of random 3 panel) - The make up of the 5th Circuit is 12 conservative judges and 5 liberal judges and this case had the unfortunate draw of 2 of the 5 liberal judges (less than 13% chance) for this panel decision.

*Should the 5th circuit approve an en banc appeal, they will likely rule in our favor.

*Should the 5th circuit deny the en banc appeal, our last stop is SCOTUS (Supreme Court).

Bottom line - stay optimistic. The fight is not over. No ruling has yet been given on the merits of the case. The injunction hearings are purely administrative. Nothing has been lost until the courts decide on the merits of the case, which has not yet happened.

Please consider supporting the cause! They need nationwide freedom loving support more now than ever!

Thank you for the update! I figured as soon as the attorneys saw that it was two liberal judges they knew what the ruling would be. What's the point of judges if they are just going to rule by Party? Could just roll dice....

The injunction is still procedurally in place until May 31, an en banc (full circuit) hearing the case is a high probability that will hopefully overturn the liberal panels decision. The injunction was always only related to the vaccine mandate under EO 14043. The safety protocols fall under EO13991 which established the safer federal workforce. Suggest filing eeo complaints for discrimination ie religious or perceived disability. The emails they send out for members are helpful and will keep you up to date.

Thanks so much for the info. I saw the motions on the Website but I didn't know the current status. I'm working in the dark here in Vermont. They just Monday opened our office and they are running in a panic what to do with the unvaxxed. EEO complaint is a good idea-- proactively. Although since I placed my accommodation request I have suffered some retaliation I believe.

Thank you for all your Exemption Primers! They are full of great advice and were instrumental in keeping my job (for now). Some backstory:

I’m a long time government employee turned contractor who’s been suckling off of the government teat for over 30 years. Writing software is the easy part; understanding the customer, the customer’s needs, and the customer’s processes over the last 30 years is the value I bring to the table. Working outside of government spaces is possible, but I would take a significant pay cut.

When Biden announced his jab mandates, I went into survival mode: I updated my resume, refinanced my house for 30 years to improve my cashflow, and started hoarding cash to tide me over between jobs. I also consulted with two attorneys on how I could keep my job. The second one gave me an excellent overview of the ADA and Civil Rights Act of ’64. The first one wasted my hour trying to convince me to take the jab. She did not like my comparison of the mandatory jab to a rape, nor did she like it when I asked her, “Well, it’s obvious that you have no interest in defending me, why did you agree to consult me?” That said my conversation with her did help hone my justification responses.

I’m not sure how I found you, probably through a Duck-Duck-Go search for exemption lawyers, but I ‘m glad that I did. I’ve been an avid reader for months now. Your Exemption Primers were instrumental in me getting a Religious Exemption. $500 for a year subscription is the least I can do to support you. Thank you!

Stop using Vanguard Group Inc., BlackRock Inc., and State Street Corp - and their mutual funds and ETFs.

These are the largest shareholders who represent a consolidation of ‘we the people’s money’, to control the boards of publicly traded companies.

Instead consider other funds and ETFs like:

Take a company like Twitter, imagine if “groups of we the people”, like say the 70,000,000 Republicans who voted in 2020, decided to be activist investors at a $50 per month investment from each, for 12 months, “We The People” could buyout and/or own Twitter by years end (if we wanted to). Or maybe we just wanted a controlling seat at the table, we could do that for a single $50 investment from each of us (totaling 3.5B).

Same here. Our local small-town bank was bought out every few years by increasingly large banks. Then within a few months, it changed hands twice. When I found out that Huntington Bank had closed the accounts of someone who owned a gun shop, that was the end. We took our money to a credit union.

The federal government asked them to cough up information on anyone who made BoA charges in Washington, D.C. the days around Jan. 6. So anyone who reserved a hotel room or traveled to D.C. and bought a cup of coffee down the street from the Capitol during those days was fair game. BoA gave up all that information on their clients.

Jeff, based on the behavior of my previous employer as well as all the discussions in the media, the only COVID vaccine exemptions seem to be medical or religious. I find this extremely disturbing! Why can’t a person refuse a COVID vaccine or seek an exemption of a mandated COVID vaccine based solely on conscience and/or freedom of choice? It seems to me that not using the argument of freedom of conscience or choice is setting up a BAD precedent for the future, when I am sure the government will come up with another ‘mandate’.

It all seems to go back to a 1905(!) SCOTUS ruling that the state can make the public get vaccines in the name of public health. We haven't had real medical freedom in a long time, if ever. It's a big problem that appears very unlikely to go away anytime soon, based on the legal arguments that challengers have been using.

However, we may be able to use a religious exemption as a way to assert our medical freedom. After reading Jeff's guide and some others, I based my exemption on a strong belief that forcing anyone to undergo medical treatment was evil and a violation of bodily autonomy, a crucial right of all people. It's considered a religious argument because it involves morality, but it's basically just saying I have the right to decide. (I'm sure many employers would deny the same argument, but mine graciously allowed me to continue working from home based on it.)

But you're absolutely right, freedom of choice should be the norm, not the special-case exemption! It's a terrible precedent.

The problem is that there is no explicit legal protection (i.e. specifically called out in legislation) except for religious and medical grounds. Religious accommodation is in the Civil Rights Acts of 1964, and medical is in the Americans with Disabilities Act of 1990. These are unequivocally clear, and companies know there's a big chance they will lose in court if challenged.

If challenging on more vague grounds (e.g. freedom of conscience), you'll have to rely on an interpretation of the Bill of Rights that isn't explicitly called out in the law. You might win but it's not clear-cut like religious or medical accommodation. Hence, employers don't feel obligated to grant it.

The good news is that a religious exemption can be quite broad and I'd encourage you to read the EEOC website regarding how employers must implement them. They cannot require a "note from the Pope" or any such nonsense, nor can they make you prove logical consistency in your beliefs.

I was granted a religious exemption from my employer (federal contractor) though my objections are very much sincere (use of fetal stem cells derived from abortion). They did ask for a letter of support from a religious leader but I told them to go pound sand as it's neither required by the law nor is it biblical. I got the exemption notice shortly afterwards. My company suspended the mandate with the legal stay, but I've kept all the exemption documentation on file in case it comes back.

Jeff, thanks for the reply. That there is ‘no explicit protection except for religious and medical’ , seems bad however broadly these might be interpreted. Who can afford the trip to SCOTUS....

I can see a letter in my future to see if ‘explicit protection, can be codified into federal and state (FL, were I currently live) law.

Wow, you can have an explicit "right to refuse medical procedures" in your bill of rights and STILL have to lean on a procedure being ineffective to give people the right to refuse it? Very discouraging. What we need is strong rulings that the state or any private entity can never, ever force or coerce anyone to have any medical intervention in any circumstances, and we're never going to get them.

My husband is a firefighter in Washington State who was put on leave without pay due to Governor Inslee’s vaccine mandate. He is one of nearly 100 in King County - meanwhile, firefighters in the rest of the state are still working. We are fighting but we are tired. Our attorney is tired. Our class action suit was broken up and our injunction was denied. Now, all the firefighters’ leaves are expiring and they are being terminated. It’s heartbreaking. Many are losing our homes, positions and ranks, lifelong careers and their love of the job… they effectively served for 20 months in the height of the pandemic with no firefighter to patient transmission nor patient to firefighter transmission and are still being told they’re a threat even though the vaccine clearly doesn’t work. It feels very hopeless.

I’m so sorry and infuriated. Another case of “from heroes to zeros”. I never invisioned the ability to support your family would be ripped away by politicians who take an oath to uphold the constitution. May they rot in hell—but pray thumping justice come sooner than that.

Sad for iJustine. We needed phase III trials. As it stands, docs just follow CDC guidance and write off any potential side effects as "nope, couldn't be - vaxxes are "safe and effective." I'm shocked that so many medical people I've talked to don't understand the trials, what was tested for, the LNPs and distribution, why there have been no prior mRNA products marketed, the changes made to the spike in the vaxxes, etc. They just go with "it's a vaccine - vaccines are safe and effective."

Meanwhile, in my inner circle (close friends and family), I've seen two cases of cancer, two bowel obstructions (and a nurse posted she's seeing many more of these in their hospital), two major heart issues and one serious bleeding event. Are they all vax-related? Probably not, but all of these people had zero problems in the five years prior (along with the rest of the family).

I'm a Fed worker and I put in my request for a Religious Exemption waaaay back in November. (Thank you, Jeff for all your invaluable guidance!) BUT, they never provided an answer. None. nothing. An automated reply that my "request was received" but that's it so far. So now that the injunction is kaput, I'm back to "am I gonna get fired" status. I think our agency messed up because they had us use the Accommodation Request system that they use for asking for a new chair or an ergonomic keyboard. That is, not a very private system. My request was copied to management as well-- how many, I don't know. I feel like they should have made sure that ONLY the "selection committee" (whoever that is) had access to the requests. What a mess. Making us take these obsolete shots that cause harm and do ZERO to stop spread is criminal. Thank God for Florida, if I get fired and have to move.
