1) Includes a medical and religious beliefs exemption (to comply with the ADA of 1990 and the CRA of 1964)
2) Does not call out any punitive measures for those that get exemptions (e.g. testing, masks)
3) Requires employers to verify "proof" of vaccination but forbids employers from keeping a copy of the proof unless the employee specifically allows it (don't allow it)
4) Repeals the law if the CDC says vaccinations are no longer "necessary"
These are all in the bill to help it withstand legal challenges but for those who know the law they are powerful tools to protect one's rights and use in a lawsuit against employers. Hopefully this bill fails (I'm in CA) but it's good to know this is in there. I already have an exemption granted and on file from the failed federal contractor mandate that will apply here to.
Always read the law itself and *never* trust press releases or news account. The laws are written by lawyers and almost always have legal loopholes. The press releases are aimed at the masses and never explain this as they know most people are too lazy and will just go along without checking into it themselves.
Edit: Thinking about point #4 above, has the CDC ACIP ever said the shots are "necessary" (the specific word in the bill)? The word I've seen used in "recommended", not necessary. Seems like there might be a good legal challenge there in that the law repeals itself due it's own language.
