SCOTUS didn't settle birthright citizenship. But Kavanaugh said Congress can fix it by statute. Within hours, a senator reintroduced a Democrat bill. The game isn't over β it just moved spaces.
funny how the left screams about Trump selling citizenship to millionaires who are self sufficient and willing to invest millions into the country but are ok selling citizenship for the price of an airline ticket
What would be hilarious is if Trump were to aggressively seek tax compensation from previous anchor babies, now adults and living offshore.
An adult child born via birth tourism faces full U.S. tax obligations upon reaching legal age, regardless of where they live or earn their income. The US should aggressively go after all US adult citizens born this way, living and working outside USA. And if person wonβt pay their US taxes, then revoke their citizenship or bar re-entry into USA until the tax bill is paid.
The United States practices citizenship-based taxation, meaning all U.S. citizens are subject to federal tax laws on their worldwide income, even if they left the country as an infant and have never returned.
β€οΈβ€οΈβ€οΈ this comment . How does the taxation land for individuals who have dual citizenship? Is it country of primary residence or some other basis.
If you hold US citizenship, you must file an annual tax return using Form 1040 if your gross income meets minimum filing thresholds, even if all of your income was earned and taxed in another country of citizenship.
There is however a βDouble Taxation Reliefβ mechanism available.
One must file 1040, but US offers tools like the Foreign Earned Income Exclusion (FEIE) and the Foreign Tax Credit to help avoid duel citizens from being taxed twice on the same income.
But, if anchor baby adult or duel citizens isnβt filing 1040βs annually and using FEIE tools - then this can be used as basis to dissolve US citizenship.
children with investment income in the US pay taxes, shouldn't the anchor babies be paying on any such income they have as well? parents can choose to claim the income themselves, but could anchor babies' parents do that?
I axed an AI that is using Grok in this instance to verify your into, and after getting it to drop its woke orientation, and update it data to give a correct answer, it confirmed what you suggested, with the caveat that the govt cannot remove involuntarily one's citizenship. It may be wrong on that, I don't know, but here's the relevant part of it's answer in case you (or anyone) are interested:
"The quote you provided is partially correct in its legal premise but contains a critical misunderstanding regarding the mechanism for "revoking citizenship."
Here is the breakdown of what is accurate and what is legally impossible under current U.S. law:
1. What is Correct: Citizenship-Based Taxation
True: The United States is one of the few countries (along with Eritrea) that practices citizenship-based taxation. This means that all U.S. citizens, regardless of where they live or how long they have lived abroad, are subject to U.S. federal income tax on their worldwide income.
True: An adult born in the U.S. via "birth tourism" (anchor baby) who has never lived in the U.S. is still a U.S. citizen and must file U.S. tax returns if their income meets the filing threshold.
True: They are required to report foreign bank accounts (FBAR) and foreign assets (FATCA).
True: The U.S. government can and does aggressively pursue unpaid taxes from citizens living abroad.
2. What is Incorrect/Legally Impossible: Revoking Citizenship for Non-Payment
False: "Revoke their citizenship... if person won't pay their US taxes."
Legal Reality: Under the 14th Amendment and Supreme Court precedent (specifically Afroyim v. Rusk, 1967), U.S. citizenship cannot be involuntarily stripped by the government as a penalty for unpaid taxes or any other crime, unless the citizen voluntarily renounces it with the intent to give up citizenship.
The Consequence: While the government can seize assets, garnish wages, deny passports, or bar re-entry due to unpaid taxes (under the "seriously delinquent tax debt" provision of the Fixing America's Surface Transportation Act), they cannot revoke the citizenship itself. The person remains a citizen forever, even if they are barred from entering the country.
False: "Bar re-entry... until the tax bill is paid."
Clarification: This part is partially true but nuanced. The State Department can deny a passport or revoke an existing passport if the IRS certifies a "seriously delinquent tax debt" (generally over $62,000 adjusted for inflation, though this amount changes). Without a valid passport, a U.S. citizen generally cannot re-enter the U.S. by air. However, they are not "banned" in the sense of losing their right to return; they are simply blocked from traveling without resolving the debt or obtaining a special waiver. They could theoretically return by land from Canada or Mexico (though this is difficult without a passport) or be processed at a consulate for emergency travel documents. But the citizenship remains intact.
3. The "Birth Tourism" Context
The Quote's Logic: The text suggests that because these individuals are citizens, they owe taxes globally. This is correct.
The Flaw: The text assumes the U.S. can use tax non-payment as a tool to strip them of the very citizenship that creates the tax obligation. This is a legal impossibility. The U.S. cannot say, "You are a citizen, so you owe taxes. You didn't pay, so you are no longer a citizen." The obligation to pay taxes stems from the citizenship, which cannot be unilaterally taken away as punishment."
Thanks for this! Barring re-entry to US or its territories of these βAccidental Americansβ until tax bill is paid can act the same as stripping citizenship - if the intent is to prevent adult anchor babies living in another country from voting, or otherwise accessing public benefits available to US citizens residing in the US.
I also asked AI whether an adult anchor baby with US citizenship, who has never resided in US since infancy - is still eligible to absentee vote by mail in US elections. The answer is in link state by state, but what Iβve read is that YES, this offshore voting is allowed if that persons parent or legal guardian residing in that particular state. Perhaps another reason to clean up the voter rolls?
"It is a government of the people, by the people, and for the people no longer. It is a government of corporations, by corporations, and for corporations." - President Rutherford B Hayes (1886)
Landmark Supreme Court cases, such as Citizens United v. FEC, have affirmed that corporations are protected by the First Amendment, allowing them to spend money on political speech.
The last three days of C&C posts from Jeff Childers are precisely why I read him every day. Especially when it comes to these complex legal issues and how he cuts through all the hot take bovine excrement to help us see what is really going on.
Well done Jeff Childers.
TAW = Trump had to get the Supreme Court to finally move - one way or the other - on these critical issues so that we can finally get them resolved legislatively and/or constitutionally. It becomes more urgent we demand the House and Senate immediately move on passing Reids 1993 legislation (and now Moreno's) and the Save America Act.
And with the Supremes restoring presidential power, the deep state (independent agencies and SES', etc) created by the uniparty - to undermine the Presidency - just got deeply stuck in both jugular veins and can be bled out. Trump can now clean house. So we previously got an end to Chevron and now all of this. FAFO! TAW!
But it was legislation which is the issue (in the case of birthright citizenship), not the constitution. So, congress needs to fix what they broke. Had the supreme's done it it would have energized the lunatics who have no problem with manipulating elections to achieve their desired outcome (they delusion-ally and criminally believe it to be their right to vote for anyone who doesnt), now they can't because this issue is with congress where it should be.
Same thing on mail in ballots which we all know have one reason to exist: manipulate the outcome of elections. We need the legislative solution: Save America Act.
We NEED to PUSH CONGRESS. If you have a Senator or Congressman coming up for election, now is the time to "fire" on them by advising you will not be voting for them if they dont get their work done.
And they restored Presidential Power and Trump can now kill off the deep state in detail.
The judicial branch suggested that the legislative branch (Congress) could do something if they want to. The problem is, Congress doesn't want to do anything, unless you count grifting and going on unofficial recess.
Well, Iβm not standing by and doing nothing: hereβs what I wrote to my Congressman:
Congressman Haridopolis,
Well, The Supreme Court just handed you an assignment, redefine Birthright Citizenship. In the meantime, why donβt you stand up and introduce a bill for a COMPLETE IMMIGRATION MORATORIUM until Birthright Citizenship is properly defined as the birth to parents who are specifically already Citizens of The United States. You and your fellow Congressional Representatives have done practically nothing to solidify Trumpβs initiatives for the past year. Itβs time for YOU to act. Itβs quite simple, IMMIGRATION MORATORIUM until you properly define Birthright Citizenship.
I wrote a similar letter to my congressman 6 months ago and mysteriously it of nowhere the NJ State Nursing Board started questioning the responses on my nursing license renewal. Watch out for lawfare. The dems play dirty pool.
Emails, letters, and calls to my representatives in my days of action have only ever been occasionally responded to by form response. Even that has only happened maybe 10% of the time.
I'll wager that none of the even read the mail they get - they have an aide/intern for each subject you select, & they probably toss anything that isn't in their mindset away while sending you a general form reply.
Thanks for doing the legwork for us, Dad! "I can do this too." (Of course my senators are Ron Johnson and the-One-Who-Wanted-Me-To-Know-She-Was-A-Lesbian...)
Mine are hardcore, lunatic democrats in the Chicago suburbs. Any letter I send will be laughed at and trigger a canned response and how Iβm wrong and they are protecting me from my error.
Hmm.. since their action (or inaction) affects the whole country, would it not be appropriate for all of us citizens and overburdened tax payers to send letters and make calls to all of our representatives? Maybe even more than once a week?
You seem to be unaware that Congress cannot "redefine" a constitutional amendment by statute. If your congressman read your letter, at most, he simply rolled his eyes.
The Supreme Court dissent just made it clear that the EO never violated the Constitution, it violated Congressional Statute. Thatβs what needs to be amended, and can be. **rolling my eyes**
The Court's "dissent" isn't the Court's ruling, which reaffirmed the 14th Amendment's provision that all children born in the United States are citizens of the United States. Period. Congress can pass any law it wants to pass and scandal-plagued Trump can sign all the EOs he wants to sign - but neither can change the 14th Amendment. That's what the Court ruled. (And it should have been a 9-0 ruling. The 14th's wording is that clear.)
Legislation can be passed by Congress, they can also pass amendments to the Constitution as necessary. An immigration moratorium would be a stop gap in the meantime.
βThe Constitutionβs Citizenship Clause may well be ambiguous on this precise question. But Congress resolved that ambiguity by codifying birthright citizenship broadly in 8 U.S.C. Β§1401(a). The executive order doesnβt violate the Constitution β it violates Congressβs statute. And Congress can change that statute.β
From Harry Reid's bill pertaining to birthright citizenship:
βAny person born after the date of enactment of this title to a mother who is neither a citizen of the United States nor admitted to the United States as a lawful permanent residentβ¦ shall be considered as born subject to the jurisdiction of that foreign country and not subject to the jurisdiction of the United States within the meaning of Section 1 of the 14th Amendment and shall therefore not be a citizen of the United States.β
A court canβt rule an amendment can βnever be changed.β π€£π€£π€¦πΌββοΈπ€¦πΌββοΈ Howβd Roe v Wade get overturned if this is so set in stone? And they simply reaffirmed the statutes, the status quo, the historical norm - not the 14th amendment. And they got it wrong. The dissent DOES matter, just as much as the majority. It may not overrule the majority for the present, that is true, but it definitely matters to overturning the obnoxious interpretation in the future. Keep drinking your Kool-aid.
Senator Bernie Moreno, Justice Kavanaugh, Jeff Childers, and Flying Dad are not suggesting changing the Constitution, but rather, implementing legislative alternatives to deal with the specific problem(s).
All of which would run afoul of the Constitution. Trump lost, which every legal mind - excepting the partisan hacks on the SC - believed he should. It's over. Accept it.
That is the "bad" of the silver lining. We can't get the SAVE act pass, something that appears as common as common sense goes. And now from the court they give us the "well legislation can fix this."
Yes thatβs the bigger problem. In order for the illegal parents to get to stay they give birth on our soil to avoid deportation. How many millions? Just 2023 alone had over 320,000 illegal births. It makes an average of 250,000 PER YEAR. How many is that after 10 years? After 20? Millions. More than enough to swing elections given most swing by less than 50,000 votes.
I wonder how many of these wombs for rent are American citizens renting them out to the highest bidder? I bet thatβs sadly part of the story & a flourishing business. Another whack a mole problem. How can it be legal, ethical & moral to use artificial insemination to create thousands or millions of human beings with no mother or father to raise them? To probably be institutionalized & used for other nefarious & evil purposes as well. A sick sordid business with our country continuing to provide the incentives.
Visas are a problem also. The mass migration into the US wasn't just a Biden event. Mass migration was first facilitated under Pres Reagan with the beginning of the VISA program.
Yes, we still have Presidential discretion under Β§1182(f) - the infamous and badly named "muslim ban." He can keep out ANY class of Alien for as long as he deems necessary to national interest. It was done by Carter (no Iranians) and others, including Trump 45.
How about the US require a negative pregnancy test 10 days prior to travel to US or US territory (like Saipan!) for all women under the age of 60? Make it inconvenient for many, like the TSA groping grandmas at airport security. We can then call it the βRoberts Requirementβ. Because like our Chief Justice, these foreign national women also have no cojones.
There is precedent for this that SCOTUS has approved and requires no congressional approval. Negative COVID test was previously required for entry into US. Now we have a new health disqualification, which are Chinese & Russians with buns in the oven.
How about we simply deport all the illegals here now... all 100 million of them?
The fact that we are not mass deporting the illegal aliens tells me this is all distraction. The valid issue of birthright citizenship is entirely secondary to the mass invasion issue which is a clear and present danger to America.
There is one test that would tell me that the Administration is serious about the mass invasion of America: build the long-promised border wall and dismantle the migration infrastructure that the Biden regime built and used to facilitate the invasion of the US. This invasion infrastructure still exists and can be turned back on with the flip of a switch.
Until we do that, all of this birthright argument is futile. Where is The Wall?
With the border controlled and very few illegals getting through, legal immigration is better controlled. But I wouldn' cry any tears if they did go to a full stop.
The SCOTUS decision taking down President Trumpβs birthright citizenship order has just presented US citizen couples with the opportunity of a lifetime to adopt anchor babies. Waitβ¦ whatβ¦
It would be hard to fathom that the US government would allow law-breaking non-citizen foreigners to abscond with βinfant American citizens.β Right?
Let it be known forthwith that if one illegally enters the US while pregnant intending to give birth on US soil - you will be deported, and we will keep our new citizen to be adopted out afterwith. Thank you for your attention to this matter.
βIt would be hard to fathom that the US government would allow law-breaking non-citizen foreigners to abscond with βinfant American citizens.β Right?ββ I LOVE THIS!!!
This is an interesting idea. My thought was that this ruling just makes it obvious that all illegals must be deported immediately and zero pregnant women be allowed to visit the US, but youβve taken it a step further.
Makes some sense, if we accept theyβre under the jurisdiction of whatever country they came from.
However, anyone residing in the US, citizen or not, is under the direct, practical jurisdiction of the US. Which makes it even easier to deport those here illegally, provided we have the proper legislation that the Executive branch is supposed to enforce.
"Proper legislation" are the two key words. Unfortunately, our current Congressional critters have demonstrated time after time that they no longer appear capable of performing their duties. In other words, they don't do sh*t after being elected other than suck a paycheck out of "The People" while providing zero (-0-) in exchange. Oh, sure, we get their little sound bites while showboating in the "Halls of Congress." Yet, tell me one significant Bill they have written, voted upon, and passed in the last year that actually helps do anything FOR AMERICA! Hell, they can't even pass a Bill supported by 85% of Americans (BOTH Dems & Repubs) that requires ID to vote. WTF?? Just saying. Apparently it all stems back to Accountability for Actions (or lack of) - and until that happens, the "charade will continue." In the meantime, all I can say in closing is, "Good luck" and buy more ammo!
In addition, a tariff or fee of $100,000 each non-aborted-fetal-person delivered, will be assessed to the country of origin of the mother--i mean birth-person
Yes, an IMMEDIATE Requirement of Loyalty Oath, attested to proclamation of Citizenship for their Gender-assigned newborn; and online classes in their primary language of Citizenship replete with expectations, requirements, responsibilities, duties, and obligations that the parent(s) MUST oversee and submit within a year and then annually until the CITIZEN's 18th birthday. Failure of parent to comply and also attain Citizenship no later than 18 years after the birth, fully forfeits THEIR status, which then reverts back to the country or shithole of origin and deportation and more fines, fees, and penalties assessed to them as well as their destination nation.
Which I understand, but if they still LIVE or reside here in this country, they are taking up accommodations that are much needed for others who need places to live. They need to not be allowed in and/or to stay.
Shawn, I love all of your throw-it-against-the-wall brain storming suggestions and the responses which followed. So much common sense in the citizenship communities. Plus, Jeff's positivity always keeps me from despondency. America is still worth celebrating and thanking God His blessings on us.
Or β¦ I read a clever idea that doesnβt leave us with the costs of raising so many babies. Citizens overseas must file taxes still. Find all of them and fine them exorbitant amounts of penalties, or charge them backtaxes owed, for not doing so - unless they denounce their citizenship. Watch how fast they give it up.
And while we are at it, plan to build federal orphanages for the little 'citizens' near the homes of the judges who were part of this atrocious 'ruling'. It's time these feckless bench sitters feels some impact for their unwise 'rulings'. This isn't an aristocracy.
Parents of a USC can be deported, but generally are not. The (poor) reasoning is that, by law, citizens cannot be deported. Of course, the child is not deported, but taken with the parents to be cared for. They absolutely could leave the child here, but don't.
Expecting logic from leftists or governments is generally a lost cause.
REQUIREMENTS must immediately be demanded of the INvading Scammers, (or "tourist-dreamers"). The Foreign-Fetus turned Citizen-baby gets a pass other than a mass of vaccinations and SNAP-provided diapers and soy-based formula. Parent(s) get to step up immediately and for the next 18 years, or face fines, fees, penalties with interest.
So many weird Hollywood couples are waiting to adopt foreign-ish children in order to diversify and inclusivize them into the Woke Cult. Great way to make every child a wanted child and promote parenting in the Anti-Life Community.
Visas may only be issued for 3 months. Pregnancy test prior to Visa and immediately upon arrival in customs. A positive test cancels your Visa and you are deported home immediately. Lying on your application bans you from the US forever. Becoming pregnant while visiting is immediate revocation of your Visa, you are deemed here illegally and immediately deported. All costs incurred including hospital bills and deportation costs will be paid by your country of origin in the form of deductions from any aid or monies provided to your country.
Well more wonderful news from the Supreme Court yesterday. How do we put lipstick on this PIG? Sorry Iβm a bit tired of every disastrous policy, outrageous law, tax spending, deficit raising idea put into motion gets kicked down the road again and again to be fixed later. If we havenβt noticed nothing ever gets fixed!
Who could ever think the writers of the 14th amendment, written just after the civil war in 1866 and ratified in 1868, would agree with the notion of birth tourist, many from enemy countries like China, coming to America, having children, getting citizenship for their child and then going back home. 36,000 births a year is the last stat taken, Iβm sure with Roberts and Barrettβs decision, this number will increase twofold, at least. Later, for now, when the child comes back to the states the parents are able to get a type of green card status as the childβs guardian. So if we are to believe the founders intention of the 14th amendment was to let pregnant woman into America so their newborn could be a citizen of America, are we to believe the civil war was not fought over mainly freeing the slaves, but the right for foreigners to come here have children in our country that then become citizens? That is an asinine and a country destroying abrogation of the original intent of the law. As Steven Miller said yesterday βCitizenship means nothing if it is open to anyoneβ. I donβt care what anyone says this is an outrageous abortion of the authors intent and to throw gasoline on the fire, from what I understand, the Supreme Court also threw in that congress cannot add restrictions to their ruling, it can only be done with an amendment. Good luck with that.
So I ask, when we have a whole political party that wants anyone and everyone to illegally come into America, possibly a billion people, and a Supreme Court that devalues being a tax paying law abiding citizen, devaluing people that may want to serve in the military, what is the reason to be a proud American? Or working my ass off, paying my taxes for, for what? So people from all over the world can walk across our border and receive more, better benefits than my family and I have ever gotten or could ever imagine? This is socialism on steroids. Iβm trying to understand the benefit too the American citizens that has worked their whole life, paid tens of thousands possibly millions in taxes, served or had family serve putting their life on the line, some being killed, some being disabled, all to protect our freedoms, and anyone can just come into this country maybe have a kid and get more benefits than the pawns, like myself. I say abolish the Supreme Court or at least recall these 5 compromised traitor scumbag lawyers on it that have the intent to destroy America from within their chambers. .
Trump needs to militarize the border and shut down or drastically restrict people coming here on flights from all around the world. He has this authority. Fight fire with fire. If we donβt America is destined to have possibly a quarter million citizen babies born here per year. It will be the death of America.
I think I could be wrong the border is shut down still? I am not hearing crossings? I think limiting tourist visas to any pregnant person is a great idea until we can get congress to pass it. Inconvenience others and not Americans. Iβm feeling like a hard ass but stop the bleeding already
There has to be a way to track people while in country. A system of passport record in, passport record out. Something to red flag people who have stayed past their visa, and they go on a wanted list.
I donβt think putting the military on the southern and βNorthernβ border is a bad idea. Also put them in airports. Stop all of this BS and letβs see what Roberts Barrett and Kavanaugh do then. At least for now it will stop this nonsense.
I particularly appreciated that TSA staff stopped the two agents carrying "vials" (stupid), headed to a lab. But I've yet to see any follow up about investigating the labs -- within the US -- Hamilton, MT, somewhere in KS and I don't know where else. But they need to go...
Not American, but deeply concerned about the bigger picture - the ways in which western societies are being systematically demolished. Citizenship means absolutely nothing to the WEF in its tyrannical quest for a one-world, totalitarian regime. So called βsocial justiceβ is a lie as Justice needs no modifier.
Agreed. Iβm tired of the black pilled people. Do they think the country has never faced crises before? Even in life we learn and improve through the things that fail to work out as weβd hoped. But if we learn from them, try a different direction, take a smaller step, we will come out ahead in the long run. I have no patience for defeatists.
if there ever was any doubt Roberts is compromised (blackmailed) this opinion removes all doubt- I hope Trump has the goods to get this traitor off the court while there is time to replace him with a patriot
What made my eyes widen was Justice Robertβs literally saying βsince we canβt know the original intent of the 14th amendment wordingβ. Oh but we can! The author of it left writings explaining it all! But Robertβs wants to punish them for not making it precisely clear in the actual amendments chosen words, even though they never fathomed it needed more clarification. Still they provided explanations that make it crystal clear, and Robertβs chose to completely ignore them. Thatβs how I know heβs a dishonest judge, because he twisted his reasoning like that to get away with voting against the EO.
You are spot-on. There are many, many early writings about the constitution. I'm surprised he said 'we can't know that'. Just interpret it. You're a judge for goodness sake.
Maybe you missed the point Kav. made whereas the exec. order is not against the Constitution but rather the later Law Congress authored. I make this same point above but to restate:
Kav. blew it. He READ the statute but recommended that Congress simply revise it. However, in reading the statute(which I did just now) it is too OBVIOUS to any human with half a brain that the context of various paragraphs indicate -- already-- that unless ONE parent at least is already a citizen the baby cannot be considered a citizen.
and, noting Dingy Harry Reid's old discarded bill that is being championed now, it stated exactly THAT@!
My point: It is ridiculous(in my little mind) that any discussion is necessary. The context of the later law which Kavanaugh himself pointed out basically SAYS what is needed, screams this conclusion.
He only needed to have the balls to say this. . . and vote with common sense.
Except you canβt do that when they have something on you π. So, they play with their words and circle them around each other, hide behind them, toss them into a salad and then laugh at us because we canβt figure out what the Hek is going on in the country. Itβs all phony bought and paid for crap. Congress will NEVER do anything. They canβt even pass a bill that most of the country is begging for. They just play their games and cash their paycheck while they head off on another paid vacation. π
I sold copiers to County offices in CA from 1980βs thru 2011. One of my departments, Vital Records, was very happy to have a copying machine that electronically deleted information on birth parents: legal status, country of origin, etc. The full birth record was saved somewhere under lock and key, the only information publicly available was devoid of the parentsβ legal status in the USA. SO, good luck pulling birth certificates to verify legal citizenship of the anchor baby.
yup, this is exactly how we're all feeling and it's why everyone is so furious right now. I'm a little afraid of what they're going to ask of us in order to "fix" it.
βare we to believe the civil war was not fought over mainly freeing the slavesβ
It wasnβt sold to the populace that way. The machinations of the radical republicans may or may not have had that in mind but if they had stated white men were to slaughter friend and family to free the slaves it never would have happened.
The South believed their starting the war was over states rights. I guess in a way it was. Southern democrats believed they had a right through their democrat states to own black people. The union disagreed.
Exactly. When I moved here to the south, thatβs what I heard. It was all about stateβs rights. I asked, what rights were yβall fighting for? The right to own slaves. Exactly! So it was about freeing the slaves.
No. 1 thereβs no way I believe southern people said that to you unless they were carpetbaggers like yourself.
No. 2 there was a lot of things going on at the time; hereβs a link that, the inflammatory title notwithstanding, makes the situation more clear. You probably wonβt read it which is fine because itβs rather lengthy but itβs out there for open minds. https://michaelofamerica.substack.com/p/the-south-was-right?r=2819du&utm_medium=ios
No. 3 you didnβt address my comment; it wasnβt sold to normie joe blow to go kill other white men, of whom some were family members, to free slaves. Thereβs a reason Lincoln didnβt drag out the proclamation until a lot of blood had been shed and people had a hatred built up in the outcome.
No. 4 I didnβt deny slavery had a part to play or wasnβt included in the reasons.
No.6 βOwning peopleβ was a lawful practice and was the actual global norm at the time. Presentism is a terrible way to view history.
From historian Peter Brown
βHistory, for me, has always been something more than a discipline β more than a set of problems to be solved, a narrative to be put together from bits and pieces of evidence about the past. It is, rather, a perpetual awareness of living beside an immense, strange country whose customs must be treated by the traveler from the present with respect, as often very different from our own; and whose aspirations, fears, and certitudes, though they may seem alien to us and to have turned pale with the passing of time, must be treated as having once run in the veins of men and women in the past with all the energy of living flesh and blood. I learned from Laurence that the aim of the historian was not simply to argue about the past; it was to bring that past alive β to recover a lost world.β
You as an adult should have gained enough wisdom to understand that nothing is simplistic when it comes to human interactions.
Excellent. Particular relevant is the final section on Patrick Cleburne. From Michael of America.
"Patrick Cleburne likewise proved prophetical in his critiques of Lincoln and the Radical Republicans. In his January 1864 memorandum, Cleburne warned that βevery man should endeavor to understand the meaning of subjugation before it is too lateβ¦ it means the loss of liberty, property, and all that makes life worth living.β Cleburne clearly understood what Southern defeat entailed. Contrary to General Leeβs optimistic, good-faith engagement in reconciliation efforts, Cleburne knew better than most that the North would enact its wrath on the South and her descendants. Prophetically, Cleburne warned:"
"Surrender means that the history of this heroic struggle will be written by the enemy, that our youth will be trained by Northern school teachers; learn from Northern school books THEIR version of the war, and taught to regard our gallant dead as traitors and our maimed veterans as fit subjects of derision."
Except that if you read the constitution of the confederacy, slavery is mentioned many times. It's also mentioned in Correspondence, editorials, and some, though not all, of the documents relating to the Ordinance of Secession. It's clear that slavery was the biggest issue for them, though certainly not the only one.
Actually the Civil War was created because of the ports. The South had all those great ports thru the calmer gulf waters while the North's ports faced the brutal Atlantic. And as more trade routes opened, the South was getting all the trade.
So Slavery was fomented as the political trigger to incite war and the North (the Bankers) won and got all the ports..
Amen and amen! I'm a very proud citizen with ancestry dating back to the Mayflower. My ancestors wanted religious freedom and freedom from England's tyranny (which still flows towards the US, BTW). And they had it -- for awhile. There are so many citizens today - legitimate and illegitimate - who haven't a clue what any of our holidays are about, why we would celebrate the 4th of July, Flag Day, Memorial Day, Veterans Day, Juneteenth, etc. Is there a saying about 'those who don't know history are doomed to repeat it'?
James I read this bit yesterday and Iβm surprised that it wasnβt taken into consideration by the SC
During the congressional debate over the amendment in 1866, Senator Jacob Howard said that automatic citizenship would include everyone born here except those βwho are foreigners, aliens, who belong to the families of ambassadors or foreign ministers.β
Wow, on one hand who can disagree with anything you say. But we will never have wins with this negative attitude. We have to have our message down, meet your neighbors and win at the ground level.
I agree with Jeff, I think many of our side is addicted to the rage.
Maybe rage is needed. For years, decades, the right keeps saying weβll get em when we control both houses and the presidency! Well we now supposedly control that and the Supreme Court but yet we think down the road Thune and the rest of the rino traitors will fix this. This is like shining a turd. Let me ask was the rage of the original patriots out of line when having to pay taxation without being represented in the English parliament? If you ask me 80% of the people are against this decision, a bigger percentage on clean elections. Should we not be outraged when time after time the peoples will is ignored. If we keep ignoring what is happening, and keep saying weβll fix it next time, or I got my check so Iβm good for the next month, donβt be surprised when people are voluntarily getting on the cattle cars being railed off to the camps. Soon your money will have zero value. Maybe thatβs what it will take for you to become outraged, well maybe notβ¦.
Jeff, I challenge you to identify one quantum of optimism in the sentence "Let Congress do its job."
Congress has not been doing it's job for all of this Century and at least 1/3 of the last one. Why do you think they will start now?
Too many socialists, RINOs, grifters, predators, and swamp rats.
I would happily accept 100,000 Chinese babies as new citizens if we could get a Congress that functions like Trump 2.0. And I don't mean as conservative, just action oriented, at least as much as you can get majorities of 535 reasonable people (that's what I want in this bargain, not what we have) to agree on anything.
Jeff, do you HONESTLY think Congress will do its job?!?!? Thatβd be a first. They RUN from accomplishment - SAVE ACT anyone?!?!? Phony Barrett is either a plant from the left or she is being threatened. Either way SHE SUCKS
As serious and on target as your comment was, it made me laugh; just as I did when when Barrett was celebrated because she was a conservative Christian. I knew then she would be, (at best) useless... but much more likely: destructive... She's far too weak, afraid. and intellectually unstable.
It seemed to me that the words "subject" and "to" got short shrift in the discussion (though justice Thomas book length dissent may show different). I didn't hear anyone dissecting what was included/reqired of being subject to a jurisdiction, though my recollection of being "subject to" a king entailed much more than just being in the vicinity.
Congress is a Uniparty. It is not a credible Third Branch of our Constitutional Republic. The idea that such a Uniparty will "fix" the 14th Amendment via legislation is a fool's errand.
Never. Will. Happen.
THE 14TH AMENDMENT WAS FOR THE PATRIATION OF THE SLAVES AND THEIR CHILDREN IN REPSONSE TO DRED SCOTT.
IT WAS NOT DRAFTED FOR EVERY PREGNANT WOMEN IN THE ENTIRE WORLD.
Robert's just did with the 14th Amendment that he did to Obamacare. He created "law" from the Judicial Branch.
Obamacare by "declaring it a tax"
Birth Right by utterly ignoring Dred Scott
He is worse than Kentanji DEI Brown. At least she is too dumb to realize she is wrong.
The only ones βunifiedβ with the RAT party, were ALWAYS RATS.
These demonRATS run under the cover of the lie of being a βconservativeβ because they cannot win running as a demoRATβ¦β¦..and then they are revealed as RINOS.
There are plenty of REAL Republicans, but not enough to overcome the threshold with RINOS in the mix.
Praying that people will understand the importance of getting out to vote in November.
Refer to the McFadden Act of 1927 for how to abolish the Fed.
The Act made permanent the Federal Reserve. The Federal Reserve was originally just temporary. It was to end within 15yrs BUT the Act made it permanent.
McFadden ironically was a staunch opponent to the concept of a Fed Reserve. Here is a speech he gave to congress. He died of a sudden "stomach ailment" not long after giving the speech.
"Mr. Chairman, we have in this country one of the most corrupt institutions the world has ever known. I refer to the Federal Reserve Board and the Federal reserve banks. The Federal Reserve Board, a Government board, has cheated the Government of the United States out of enough money to pay the national debt. The depredations and the iniquities of the Federal Reserve Board and the Federal reserve banks acting together have cost this country enough money to pay the national debt several times over. This evil institution has impoverished and ruined the people of the United States; has bankrupted itself, and has practically bankrupted our Government. It has done this through defects of the law under which it operates, through the maladministration of that law by the Federal Reserve Board and through the corrupt practices of the moneyed vultures who control it.
From the Atlantic to the Pacific our country has been ravaged and laid waste by the evil practices of the Federal Reserve Board and the Federal Reserve banks and the interests which control them β¦ This is an era of economic misery, and for the conditions that caused that misery, the Federal Reserve Board and the Federal Reserve banks are fully liable.
The imperial power of elasticity of the public currency is wielded exclusively by the central corporations owned by the banks. This is a life and death power over all local banks and all business. It can be used to create or destroy prosperity, to ward off or cause stringencies and panics. By making money artificially scarce, interest rates throughout the Country can be arbitrarily raised and the bank tax on all business and cost of living increased for the profit of the banks owning these regional central banks, and without the slightest benefit to the people. The 12 Corporations together cover and monopolize and use for private gain every dollar of the public currency and all public revenue of the United States. Not a dollar can be put into circulation among the people by their Government, without the consent of and on terms fixed by these 12 private money trusts.'β
Attorney Jeff presents an encouraging perspective, one that relies on a Constitutionally-designed branch of government and a Constitutionally-outlined method of clarification by statute.
'Tis a shame that today's Congress has proven itself incapable of legislating anything that has become intensely partisan.
βThis time, legislators canβt drag their feet claiming that Trump is asking them to do something unconstitutionalβ¦β Correct. But that wonβt stop them from dragging their feet for some other excuse.
Question: Even if the senator Harry Reid bill becomes law (how that ever happens with the silent filibuster Iβll never know) wonβt that be immediately blocked and lose at SCOTUS because of the ruling yesterday? Trump as usual, is right about everything, when he congratulated Xi while SCOTUS enabled the foreign take over and destruction of America. For starters, outlaw dual citizenship. Either you are American or you are not!
The supreme court basically said congress can fix this. I don't think they will overturn it if congress puts it into law. At least, the majority on the supreme court will not.
God bless Jeff Childers! Talking us down from the ledge again. Iβm not done reading the column yet, but what a joy to hear Jeff refer to Reid as βDingy Harryβ π. Shades of the late, great Rush Limbaugh.
I lived in northern NV for over 20 yrs. I hated Harry Reid and his obvious criminal behavior. I could not conceive how he was kept in office. I laughed loudly when he was beat up by his CCP overlords (they said he fell down stairs); it was 2014 directly after his attempted take over of the Bundy Ranch fell through. Everyone was pissed that he had armed the BLM with not only pistols, but heavy arms and was moving to confiscate land from an American citizen, on behalf of a Chinese company. But his son was just as greedy as old Dad (guess this is where Hunter Biden got his training) and was listed on the "solar farm" CCP company as an officer. American Patriots showed up and surrounded the ranch with all their own firearms & kit and dared the BLM to step foot inside the perimeter. (this was just after the Klamath WA River wars, so they were really riled up). It was a stand off for a couple weeks, then old Harry folded and then had the "stairs" incident.
How about an immigration moratorium until we can get this mess under control?
funny how the left screams about Trump selling citizenship to millionaires who are self sufficient and willing to invest millions into the country but are ok selling citizenship for the price of an airline ticket
Brilliant! And would have dems chasing their tails again.
β€οΈβ€οΈβ€οΈ this comment . How does the taxation land for individuals who have dual citizenship? Is it country of primary residence or some other basis.
Yes, duel citizens are also required.
Depending on the level of your income, you file taxes in both countries of your citizenship.
brilliant work around
Great idea, Matt.

I like it!!! π
Biden flew them here for free and without any name on the manifest.
Yeah, this. WTAF?
"It is a government of the people, by the people, and for the people no longer. It is a government of corporations, by corporations, and for corporations." - President Rutherford B Hayes (1886)
didn't you hear that corporations are people now legally...just with extremely limited liabilities.
Landmark Supreme Court cases, such as Citizens United v. FEC, have affirmed that corporations are protected by the First Amendment, allowing them to spend money on political speech.
Thatβs a great point!
And we taxpayers often pay for those plane tickets!
FAFO! TAW!
should have been a no brainer for the court (excludes the leftist) and would have put it to bed - getting thru congress is wishful thinking
I understand your concern and somewhat agree.
Respectfully,
I wrote a similar letter to my congressman 6 months ago and mysteriously it of nowhere the NJ State Nursing Board started questioning the responses on my nursing license renewal. Watch out for lawfare. The dems play dirty pool.
scary, but not surprising.
Emails, letters, and calls to my representatives in my days of action have only ever been occasionally responded to by form response. Even that has only happened maybe 10% of the time.
They really don't care.
Nope, they do not!
Not where the money is.
My Congreeman takes
1 million dollars from AIPAC.
Check yours at AIPAC tracker.
The idea is that their salary (which they can raise at will) is supposed to be where the money is.
That's the ideal, the reality is much different.
Don't be afraid to send it to other Senators too. I do. Hey, they come asking for me to contribute to their campaigns, works both ways.
Good idea! Squishy ones might appreciate the attention.
Agree completely. Should write and call too!
Hmm.. since their action (or inaction) affects the whole country, would it not be appropriate for all of us citizens and overburdened tax payers to send letters and make calls to all of our representatives? Maybe even more than once a week?
Post on their official social media?
Hope you don't mind if I upload your letter to a different platform.
No problem, was hoping we could really get something going with that as a template.
Whether he even reads it or does anything is anyoneβs guess.
Good for you Dad, I would have had to swallow very hard, if at all, to write the wordβ¦. Respectfully.
Good call, FD.
I sent this to my very Blue and Liberal senators. If you see something say something!
I will paste that same letter to my Rep. . . . EMMER.
Thank you very much for your effort!
π₯π₯π₯
Seems like the Senators are the ones who need to heard this. Hope you wrote them, too. Off to write mine, but I'm living in socialist Colorado. π€¬
Beautiful. Mind if I use it?
Here is a Kavanaugh comment:
βThe Constitutionβs Citizenship Clause may well be ambiguous on this precise question. But Congress resolved that ambiguity by codifying birthright citizenship broadly in 8 U.S.C. Β§1401(a). The executive order doesnβt violate the Constitution β it violates Congressβs statute. And Congress can change that statute.β
From Harry Reid's bill pertaining to birthright citizenship:
βAny person born after the date of enactment of this title to a mother who is neither a citizen of the United States nor admitted to the United States as a lawful permanent residentβ¦ shall be considered as born subject to the jurisdiction of that foreign country and not subject to the jurisdiction of the United States within the meaning of Section 1 of the 14th Amendment and shall therefore not be a citizen of the United States.β
.... not quite as clear as you want it to be.....
It's over. Accept it.
If you believe it's over, you are either playing dumb, or we have to consider the possibility that it's not an act.
tHe WaLlS aRe cLoSiNg iN!
Why donβt we at least try and see what Congress can do, better than βgoing quietly into that dark nightβ.
That is the "bad" of the silver lining. We can't get the SAVE act pass, something that appears as common as common sense goes. And now from the court they give us the "well legislation can fix this."
True, I hope it can change.
Well done, Flying Dad, both the letter to the Representative (which I will adapt and send to mine) and the βhope and changeβ pun.
Yes, but that sounds a bit too much like Obamaβ¦π
Haha. Didnβt see that at first. Oops
No visa of any type without a negative pregnancy test!
That just captures some of the birth tourism. We need to stop the ones that become pregnant here too.
I should have read farther.
And, since the left thinks that βmen can get pregnantβ the βmenβ need to be tested too!!!!
lol
π€£
Ha! Good one C Stone!π€£

Yes
Amen
Visas are a problem also. The mass migration into the US wasn't just a Biden event. Mass migration was first facilitated under Pres Reagan with the beginning of the VISA program.
And required renewal with negative test every 3 minutes nthd, subject to immediate deportation. And if no test, child doesn't get citizenship.
Doesn't prevent them from getting pregnant here.
No Visas for women of gestational age?
Reminds me of the Neil Boortz argument that when the bathroom is flooding the first thing you don't do is start bailing water, you turn off the water.
Not if itβs a complete moratorium. Just stop ALL of it for a while, itβs totally insane right now.
We have done that before , I believe, so there should be precedent.
There is. So no one can whine about "norms and traditions." Neither of which have the force of law.
Yes, we still have Presidential discretion under Β§1182(f) - the infamous and badly named "muslim ban." He can keep out ANY class of Alien for as long as he deems necessary to national interest. It was done by Carter (no Iranians) and others, including Trump 45.
It's all as planned. What mess?
How about the US require a negative pregnancy test 10 days prior to travel to US or US territory (like Saipan!) for all women under the age of 60? Make it inconvenient for many, like the TSA groping grandmas at airport security. We can then call it the βRoberts Requirementβ. Because like our Chief Justice, these foreign national women also have no cojones.
There is precedent for this that SCOTUS has approved and requires no congressional approval. Negative COVID test was previously required for entry into US. Now we have a new health disqualification, which are Chinese & Russians with buns in the oven.
bao bao no bueno Meiguo
^^^ Control immigration and itβs a non-issue.
Being built - last I heard
100% YES!
Could be anti semantic.
How about ending chain migration? I think if we do so, birth tourism will be a lot less attractive.
With the border controlled and very few illegals getting through, legal immigration is better controlled. But I wouldn' cry any tears if they did go to a full stop.
Wow! That's just too logical. Let's plug the hole before we start bailing the boat.

Very good point, Dan!
The legislation exists; the will in DC to enforce it does not.
In addition, a tariff or fee of $100,000 each non-aborted-fetal-person delivered, will be assessed to the country of origin of the mother--i mean birth-person
Not a problem in our era of "imaginary currency" and exploding global "debt" Just add a few zeros and it's all good.
Unless, of course, they will denounce/revoke the US citizenship of the child!
The costs to administer this would be staggering.
Which is why the $100k fee assessed to the Nations of origin.
While I understand your point, it also relies on the assumption that Congress would be even vaguely interested in doing any of those items.
History suggests not.
Aside from the immediate lawsuits, likely arguing unequal protection under the law, as some 'citizens" would have requirements others do not.
The onus is on the Non-Citizen parent(s) NOT the US Citizen minor.
Correct, Congress enjoys exploiting and screwing the Citizenry at the expense of the Republic and Constitution more than anything else
Thatβs basically how theyβve defined it. Make a baby here for citizenship, you leave it here. Buhbye.
So many weird Hollywood couples are waiting to adopt foreign-ish children in order to diversify and inclusivize them into the Woke Cult. Great way to make every child a wanted child and promote parenting in the Anti-Life Community.
Shawn - please post this formula on cabinet X accounts!
Thatβs a brilliant idea.

And call these new rules the βRoberts Requirementβ
Matt L. Sundance of the Conservative Treehouse posted a Robertβs Requirement.
https://theconservativetreehouse.com/blog/2026/06/30/the-roberts-requirement-pregnancy-tests-for-u-s-travel-visas/#more-284873
I like this idea best
Keep dreaming!
This will make the left immediately pro-life at conception. They cannot say itβs ok to deport the new US citizen and not say itβs a human being.
I'm quite sure these people can figure out how to "game" the system. Keeping them out completely is a better solution.
I say abolish the Supreme Court or at least recall these 5 compromised traitor scumbag lawyers on it that have the intent to destroy America from within their chambers. .
J.Goodrich
I can feel your post β€οΈ I donβt disagree with you itβs exhausting and disappointing but we push forward and try another angle πͺπ½πΊπΈ
Building a real wall instead of wasting billions on another endless war would have been more productive
And weβll be paying the freight.
Agreed. Iβm tired of the black pilled people. Do they think the country has never faced crises before? Even in life we learn and improve through the things that fail to work out as weβd hoped. But if we learn from them, try a different direction, take a smaller step, we will come out ahead in the long run. I have no patience for defeatists.
Me neither! President Trump gets shot in the ear and does what? Give up? No. "Fight, fight, fight!"
if there ever was any doubt Roberts is compromised (blackmailed) this opinion removes all doubt- I hope Trump has the goods to get this traitor off the court while there is time to replace him with a patriot
His last pick wasnβt too good. Just saying.
I could see Ron DeSantis being a good justice, and hardcore on the Constitution.
Exactly, if he βcanβt know thatβ then he should step down, as he is clearly unqualified for the job at hand
It doesnβt matter what WE are subjected to, just like Clot Shots, the high and mighty donβt follow the law.
βare we to believe the civil war was not fought over mainly freeing the slavesβ
No.5 Matt Walsh does a fine job of connecting the cause back to John Browns raid https://youtu.be/BLdyMPptl6Q?is=xtwUhhTH9z3ll7-V
Thank you for that link to MichaelofAmerica. I wasn't aware of him. Great writing and a great history lesson for all.
If only people will read it.
Is that not part of states rights?

And I don't mean as conservative, just action oriented, at least as much as you can get majorities of 535 reasonable people (that's what I want in this bargain, not what we have) to agree on anything.
well it was what only 50+ years to get Roe where it belongs - so what another 50 years for the globalists/ communists to destroy the country
The virtue signaling of adopting Haitian children was a tell from the beginning.
Not as much as Robertβs. And Barrett is under his tutelage so to speak. She is controlled by him. At least thatβs how I see it
The torch has been passed to Congress so many times. What will be different now?
FOR REAL. They do nothing.

Sorry, guess I'm too dense to understand the point of the link you share. Good music, but...
I grew up listening to Steve Winwood.
Steve Winwood is awesome. This Swedish DJ, not so much.

Good morning C&C the month we celebrate America β€οΈπ€π
Morning Patti!
Hey Shayne!

No. It isnβt a uniparty.
We are NOT like the demonicRATS.
I have two direct lineage descendants who fought in the Revolutionary War.
I often wonder how they would view the current state of the USA.
SCOTUS needs to rule on campaign finance of Congress
as well as the Federal Reserve right to print money.
And what isnβt partisan in todayβs Congress?
βThis time, legislators canβt drag their feet claiming that Trump is asking them to do something unconstitutionalβ¦β Correct. But that wonβt stop them from dragging their feet for some other excuse.
"Let Congress do its job." *CRICKETS*
Question: Even if the senator Harry Reid bill becomes law (how that ever happens with the silent filibuster Iβll never know) wonβt that be immediately blocked and lose at SCOTUS because of the ruling yesterday? Trump as usual, is right about everything, when he congratulated Xi while SCOTUS enabled the foreign take over and destruction of America. For starters, outlaw dual citizenship. Either you are American or you are not!
The supreme court basically said congress can fix this. I don't think they will overturn it if congress puts it into law. At least, the majority on the supreme court will not.
No it wonβt. Only congress can fix this with clarification
Anti semitism laws will kick in.
God bless Jeff Childers! Talking us down from the ledge again. Iβm not done reading the column yet, but what a joy to hear Jeff refer to Reid as βDingy Harryβ π. Shades of the late, great Rush Limbaugh.
Just yesterday (I think), I wrote about how much I miss Rush! Dingy Harry Reid, Plugs Biden, Chuck-U Schumer, etc.
Mrs. "the Knife"
