With this immunity, Fauci had two choices. He could either testify truthfully...or... because he didn’t want to testify truthfully, risk a contempt charge....risk that prosecution.

I hate to defend Fauci, but Rand Paul is wrong: there is no basis for suspending anyone’s protection under the Fifth Amendment. That’s why it’s written the way it was. And to think Madison started out opposed to a bill of rights, but thankfully changed his mind.

I'm no lawyer (my husband is, but he's outside), but the point of the Fifth Amendment is to protect the accused from providing the government with information they can use to imprison, I'm pretty sure.
The government does this with less fortunate criminals, makes them immune from prosecution so that they can provide evidence.
In this case, the Top Criminal, Biden, already made him immune from prosecution, so he shouldn't be able to use the Fifth.

We can’t know that Madison was not wrong to change his mind. Didn’t his fears with the bill of rights sort of come to pass? We now litigate on finer points of the meaning of each amendment, as the collective weight of a Constitution that limits granted powers to government is lessened by the accumulated assumptions of many over the years that it grants rights to us.
The Constitution's body doesn't grant us rights per se as the Bill of Rights does, but it does so in a sort of back-handed way: it limits the scope and the reach of government by dividing the federal power into 3 branches, and one of those is further divided, and then again dividing federal from state power.
True enough, Madison and Hamilton mulled this point in the Federalist Papers. If I remember right, Hamilton made the case that these rights were already implied in the Constitution (that they were trying to get approved). And was wary of “overspecifying” rights, running the danger of implied, unspecified rights. Which lead to litigation. But I’m still glad Madison changed his mind.
The story I heard was that the wealthy landowners who wrote the Constitution to replace the Articles of Confederation didn't want to put the rights in, but the people of the colonies refused to vote for it unless it was written down.

It seems to me that the threat of state charges is a sufficient basis to plead the fifth, on the theory that it's at least possible to bring state charges for which there is no superceding federal charge. Too bad President Autopen didn't orchestrate a 50-state pardon while he was at it.

Rand Paul, with respect to the 5th, uses the term 'privilege' (as per according to the above). But the 5th is not a privilege, it is a Right. This is a key difference in distinction to be recognized.
Privileges are state grants to do what one otherwise cannot do. Rights in the old American Law (Common Law based) are absolute, unalienable ... that is, non-transferable, not lapsing, and adhering to the natural person. The Rights of Liberty are God conferred Rights (not privileges by common use) and subject to the Absolute Sovereign alone. And thus Rights are absolute Higher Law. How do we know this? Because the language of historical usage tells us so. That is, the Rights of Liberty were stated as being not able to be 'infringed upon' nor 'trespassed against' by any agency of Man (government, for example). Knowing the difference between Rights and Civil Rights IS the way back home. It is also the reason why the atheistic humanists war continually against God.
However, Rand Paul could be entirely correct to use the term 'privilege' as referencing 'the 5th' and as I believe he is. This by implication could only mean the entire old American Law Order in use at the time of the original constitutional framings has been usurped in a clever bait and switch over extended time. If so, then a lot of the words may sound right, but by evidence seen are word-twisted into employments meant to deceive. Why would you a think a lab leak is not possible? There are numerous other documented examples. In this case it looks likely for technical reasons, and an intentional leak doesn’t make sense to me:. why release it in the city where they made it, leaving a big clue, instead of in the US where they needed it to fix the election? We have seen this tactic before. School Districts and State Governments use it all the time.
Example... the Teachers' Union decides that keeping schools open is detrimental to their members' because some may get the virus. Therefore, they all ban together to disrupt the education of the children throughout the entire State! But none are punished, none are sued and all get paid as essential workers, though they do not run the risk that a grocery clerk, nurse, doctor nor janitor in a hospital does.
The children lose years of education and the teachers get a staycation, while saving on travel expenses, so the utility bill equals out. The District saves on utility bills, but must invest in cyclone fencing to create a prison effect to keep the neighborhood from enjoying the field for exercise and possibly to congregate to discuss the Plandemic in the safety of open air. Meanwhile the parents take all the responsibility for the education, pay higher utility bills, often must now pay a nanny or responsible adult to oversee the homeschooling to enable the parent to work in another part of the house without constant interruption, in order to pay the bills and keep a roof over the child and themselves!

Private stores unable to compete will close up. I have a suggestion for New York FP (for profit) grocers: everyone get together and add 30% to everything the government grocery’s will offer. GG (government grocery) price is pegged to the retail price that the for profit grocers posts. Then FP groceries offer 30% discount on those items if they shop with them. Make this a zero sum game. If government stores smell a rat and give a deeper discount, change your retail price accordingly.

A person who has received and accepted a presidential pardon generally cannot invoke the Fifth Amendment to refuse to answer questions about the pardoned federal offenses during Senate (or other congressional) testimony.

The government does this with less fortunate criminals, makes them immune from prosecution so that they can provide evidence.
In this case, the Top Criminal, Biden, already made him immune from prosecution, so he shouldn't be able to use the Fifth.

True enough, Madison and Hamilton mulled this point in the Federalist Papers. If I remember right, Hamilton made the case that these rights were already implied in the Constitution (that they were trying to get approved). And was wary of “overspecifying” rights, running the danger of implied, unspecified rights. Which lead to litigation. But I’m still glad Madison changed his mind.
The story I heard was that the wealthy landowners who wrote the Constitution to replace the Articles of Confederation didn't want to put the rights in, but the people of the colonies refused to vote for it unless it was written down.

Rand Paul, with respect to the 5th, uses the term 'privilege' (as per according to the above). But the 5th is not a privilege, it is a Right. This is a key difference in distinction to be recognized.
Privileges are state grants to do what one otherwise cannot do. Rights in the old American Law (Common Law based) are absolute, unalienable ... that is, non-transferable, not lapsing, and adhering to the natural person. The Rights of Liberty are God conferred Rights (not privileges by common use) and subject to the Absolute Sovereign alone. And thus Rights are absolute Higher Law. How do we know this? Because the language of historical usage tells us so. That is, the Rights of Liberty were stated as being not able to be 'infringed upon' nor 'trespassed against' by any agency of Man (government, for example). Knowing the difference between Rights and Civil Rights IS the way back home. It is also the reason why the atheistic humanists war continually against God.
However, Rand Paul could be entirely correct to use the term 'privilege' as referencing 'the 5th' and as I believe he is. This by implication could only mean the entire old American Law Order in use at the time of the original constitutional framings has been usurped in a clever bait and switch over extended time. If so, then a lot of the words may sound right, but by evidence seen are word-twisted into employments meant to deceive. To put it plainly, we are continually being gaslighted by a misuse of proper word meaning devoid of all historical standards of usage.

Why would you a think a lab leak is not possible? There are numerous other documented examples. In this case it looks likely for technical reasons, and an intentional leak doesn’t make sense to me:. why release it in the city where they made it, leaving a big clue, instead of in the US where they needed it to fix the election? We have seen this tactic before. School Districts and State Governments use it all the time.
Example... the Teachers' Union decides that keeping schools open is detrimental to their members' because some may get the virus. Therefore, they all ban together to disrupt the education of the children throughout the entire State! But none are punished, none are sued and all get paid as essential workers, though they do not run the risk that a grocery clerk, nurse, doctor nor janitor in a hospital does.
The children lose years of education and the teachers get a staycation, while saving on travel expenses, so the utility bill equals out. The District saves on utility bills, but must invest in cyclone fencing to create a prison effect to keep the neighborhood from enjoying the field for exercise and possibly to congregate to discuss the Plandemic in the safety of open air. Meanwhile the parents take all the responsibility for the education, pay higher utility bills, often must now pay a nanny or responsible adult to oversee the homeschooling to enable the parent to work in another part of the house without constant interruption, in order to pay the bills and keep a roof over the child and themselves!

I have a suggestion for New York FP (for profit) grocers: everyone get together and add 30% to everything the government grocery’s will offer. GG (government grocery) price is pegged to the retail price that the for profit grocers posts. Then FP groceries offer 30% discount on those items if they shop with them. Make this a zero sum game. If government stores smell a rat and give a deeper discount, change your retail price accordingly.
