What is so troubling to us non-legal Americans is that no Justice asked the most basic and most important question: where in the constitution does the federal government—ANY branch—have the authority to force injections on citizens? Where? Which article and which which section?
The answer is, of course, none—that authority does not exist. The justices all asked what I found to be useless questions about useless information—how many people have been infected, how much is the costs, Sotamayor flat out fabricating information about sick kids—which is all useless and has no bearing on the critically fundamental decision they had to determine—where in the constitution does the executive branch think they have the constitutional authority to force serums into us? The only determination they had to make in both of these cases was never even asked.
And now they’ve established precedent. As Jeff references, this should have been tackled 10 years ago. The Court allowed the tyranny camel to poke his nose under the tent, and now the SCOTUS has established, with the CMS case, that yes—the federal Govt can and will force Americans to be injected with serums.
The debate is no longer about “IF” the government can do that…it’s now about “TO WHOM” they will do that.
And that list of “to whom” will grow over time. It never, never, EVER goes the other way.

There will always be differing ideas, which is why we need informed consent and competition in healthcare. Medical authorities today are shutting down competing ideas. I wonder if Wilk v AMA could apply in some way.
What I don't understand is how unconstitutional precedents seem to be uncorrectable. Until I start to see these decisions - like the mother of all: Wickard v Filburn and it's bastard offspring Chevron Deference - reversed, I don't see much positive in any of these "wins".
Courts, IMO, must start making Constitutional principles the core of their decisions. Until then, we are a government of men, not laws.
The only solution is a constitutional amendment protecting the right to bodily autonomy. The Govt shall make no law that interferes with an American's right to accept or deny any medical treatment.
Of course now is not the time to do that. Public support for vaccine mandates is still pretty high. But as time goes on and more breakthroughs happen, followed by ongoing booster mandates, public opinion will shift.
Completely agree. The hospitals that required the flu vax would allow deniers to wear a mask (like a scarlet letter), however, it wasn’t required in EVERY healthcare entity & one could pursue a healthcare position elsewhere. With THIS madness, the whole healthcare system could come to a crashing halt. Now, I ask...since this is all in the name of “patient safety”...where does that leave patients? I hear some restaurants are using robots to help with staffing shortages. Maybe they can get a few DocBots or NurseBots to care for patients. They’re gonna need something because the future doesn’t look good with impending delays in care. Thankfully, my place of employment “granted” me an exemption, but what if I wanted to seek employment elsewhere? Or work per diem in a hospital? I won’t get hired.

Im just at the cusp of leaving my partnership practice here. I am an equity partner and I have a whole life built here in NNJ. BUt Im sick of it. I am maneuvering to retire and bow out gracefully . Us liberty minded sane rational people have to try to create parallel structures. Im trying to work with the AAPS and frontline doctors to create medical facilities that dont participate in medicare. Medicare is unconstitutional and bankrupt anyway. The seniors who value good medical care will start to abandon medicare providers.

Absolutely. The silver lining to all this is that governments around the globe are behaving so ridiculously that more and more people are waking up to the reality that government is fundamentally broken as an institution and can’t possibly accomplish the mission it purports to, no matter how benevolent and well-intentioned its leaders may be. It’s certainly not obvious, however, whether it would be more likely for us to be able to somehow put the toothpaste mostly back into the tube (in the form of a government more in keeping with the original design of our Constitution) or if it would actually be easier to convince our fellow citizens that freedom and markets will solve society’s problems better, quicker, and more fairly than central planners. I tend to agree that it will be the latter, only because I think a complete collapse of existing systems will be necessary to motivate the masses to make such sweeping changes. The unfortunate reality (aside from the chaos which always accompanies such transformations) is that we don’t know that it would ultimately result in a smaller (or zero) government situation. With the amount of socialist mind poison being forced onto today’s young people through public education and the capture of academia, they could just as easily conclude that it was “unrestrained capitalist greed” responsible for the collapse in the first place. Sadly, the lesson may actually be impossible to learn.
I heard an RFK Jr podcast over the summer where he was talking with another experienced lawyer. They said it is very difficult to win a case based on the US Constitution. They gave an example of something that was unconstitutional but instead they sued and won on it being against the California State Constitution which is more detailed. Then lawyers in other states modeled (or could) lawsuits off theirs.
Nor do you read an authorization for the creation of CMS, HHS, HEW, or the Secretary, Medicare and Medicaid programs. If the Court judges that the Secretary does have Congressional authority to issue this rule, then wouldn't it follow that the Court assumes his Department and its programs are also Constitutional? That question wasn't argued by the Plaintiff, et al.

I think this expedites the creation of a bifurcated health care system ala England. Hospitals are effectively government run now. Car accident - go to a hospital. Overall healthcare - go to private doctors, for those who can afford to do so.
Good point. The American Medical model is great for trauma care and critical emergencies (like heart attack or stroke) but for everything else, it sucks.

You're right. I used them to get my Rx's for hydroxy and Mectin. But it looks like she is going forward with a vaccine passport. The law is already on the books, just not implemented yet. She is selling it by saying it will be voluntary. Yeah right.
I'm a federal contractor and I was told 2 hrs. ago that the rulings doesn't apply to me, testing and mask wearing and possible forced vaccination is still in full force, so this isn't over by a Longshot.

The problem is that, even absent a mandate, these companies can continue to make up their own nonsensical rules. This was always about coercing private business into doing what the Federal Government can't. They knew that businesses would have to begin taking steps to comply with their arbitrary timelines, and that people would be forced into doing things they knew weren't right for them, even though these mandates were never more than press releases.

Here in Maryland, our governor is doubling-down on his emergency orders and stoking everyone's fears. I assume the striking down of the OSHA mandate simply leaves it to the various State governments to support employer-mandated vaccines.
Something I haven't seen mentioned lately; these vaccines are still experimental/EUA. How can any agency or employer legally mandate these despite acknowledgement that they do not prevent infection or transmission? Even if we 100% believe the "somewhat reduces severity of symptoms" approach, that doesn't fit into a public health crisis to support mandates.

The other thing Jeff didn't address (and I assume he will after he gets out of his drafting haze) is that the OSHA decision only lifted the 6th Circuit's decision to lift the stay that was put in place by the 5th Circuit. So in essence, it seems there is still a battle to be fought in order to get the 6th to agree w the 5th.
I work at a college and I think students should withdraw from any college/university that requires this and find another higher learning institution that respects freedom and privacy. They need to start feeling it financially. If enrollment numbers start decreasing and they miss out on the $$$ maybe they will rethink their policies. The funny thing is at the college I work at, they are scratching their heads wondering why enrollment keeps dropping. I wonder why! People want freedom and privacy!
Not to mention giving science a back seat to politics and virtue signaling. What most of these colleges have done is to collect non-refundable tuition payments in advance from students on the promise of normalcy, and then imposed sweeping mandates, mask policies, and lockdowns on in-person learning and social activities after the fact. It's a criminal bait and switch, and if I were a student or the parent of one, they would never see another dime of tuition from me.
They have, through a couple phases of programs, but there are stipulations regarding how that money can be used. In 2020, money flowed from the Fed spigot and was spent all sorts of ways, but subsequent funding had many more restrictions and colleges that spent it like drunken sailors are in for a rude awakening.
That is true. Our college district has received millions (not for testing, but for other initiatives). They do not want to loose that money so unfortunately, they will do what they need to keep it.

True, but he established the mask mandate across all State and public buildings, "Shared Spaces", has restricted elective surgeries, bypassed licensure requirements so that recent grads may begin practicing nursing without have to pass examinations, is crowing about Maryland performing 63,000 tests per day (when our hallowed Federal agencies are advising away from this), further pushing vaccines and boosters on children 12+ and with shortened eligibility of 5 months post-last jab.
His FB statement regarding not supporting broad mandates rings hollow, especially after ramping up the very things that even Narrative 2.0 are admitting cause more harm than good, or at the very least provide no benefit.

After reading and ruminating some more, it feels like even with the OSHA mandate we won the battle but lost the war. My employer and likely many others went ahead with implementation of the mandate and even with the decision there is no sign they'll walk it back even if there's no OSHA penalty for not complying. It appears that there's nothing in the decision requiring them to back off, and there appear to be provisions like "crowded workspaces" where a mandate might be upheld. It's also disappointing that there's no reference to actual statistics on efficacy even as the EU, WHO, Japan etc. are now realizing there's something amiss - perhaps a topic for future legislation or court decision?
There are two important wrinkles to this- one that you'll probably like more than the other, but neither of which are too bad. They're like Taco Bell farts in a car as opposed to White Castle farts in a freight elevator going up to the 60th floor.
Uno, when OSHA was initially happening, it looked likely to fail based on EMPLOYER LIABILITY ISSUES. At first, OSHA explicitly stated that if an employer mandates vaccines and those vaccines hurt/kill an employee, THAT EMPLOYER IS LIABLE with precedent from other workplace mandate injuries, like getting helmet-head.
With OSHA entirely removed from an employer mandate, there's no buck to pass- the employer is wholly responsible for their own standards. This means a couple of things are likely to happen to employers who just love wearing brown and maintain their "own" mandates after OSHA goes away:
1) lots of lawsuits when (not if) an employee dies or is critically injured by a vaccine. They may not all win, they may be hard to prove in court in this climate, but there will be a tsunami of them, and that's enough risk to make risk-averse woke-shilling corpies back down.
b) this is the one you may not like as much- companies make their mandates and freely enforce them and they're bullshit and there's no protection or liability, just like now. But here's the silver lining: this allows market forces to take over. We all move in different circles, but I've heard plenty of stories about people walking out of interviews after the subject of vaccine mandates come up only to get better jobs elsewhere at places with no mandates. It's already happening because of the CMS mandate, no matter what the future of it is: healthcare workers are moving all over the country to find more receptive environments.
A Great Sorting is underway, and while it sucks a lot that people may find themselves needing to uproot their families and move away from tyrannical states and localities (yours truly included), it will quickly impoverish the businesses and areas that double down on tyranny.
I hope this makes you feel a little better? There's no question that resisting this tyranny will be uncomfortable and require sacrifice, but the current legal climate at least still makes it possible to do so peacefully.
Exactly -- the "free market" may sort this out in time, if the gov't stays out of it. If United has a vaccine mandate, but Southwest doesn't, pilots can change jobs. Over time United loses, faces litigation, and in the end will probably forget about it's mandate. If California is crazy, people will leave. We've got a big country here, thank God. Now, over the next 100 years, the states might become so different that the United States can't hang together anymore, but that's a whole different can of worms.
To be honest, that's exactly what I see happening, but at least in that way it comes about by regular people making choices and not a tyrannical government succeeding in controlling the minute movements of every man and woman.

The question is, who poses the biggest financial risk. Take banking: JPMC is used to being sued by employees. They quietly write checks. What’s the most they write, $10M? But the Federal govt can really stick it to them. They can prosecute for years as a DPA, they can cut them out of Treasury auctions, Discount Window funds, State and Federal pension funds, investment banking deals. Literally billions of $.
But now the Fed has nothing to stick it to them for. Imposing employer mandates is no longer handed down by Brandon fiat. Until things get a lot worse, you can't literally force people to work for you.
I agree with this. I was initially happy when I saw the headline, but after I digested it, my heart sank a bit. I work for a woke company and this doesn’t block them from moving forward at all, in fact, I bet they double down. Their pride and arrogance will have them pushing forward with this madness.

Have you tried requesting an exemption? It at least delays things. I've applied for a religious accommodation at my job (Fed govt) back in November -- crickets from them so far. Will they grant it? When? Will they deny it in six months and try to make me take a shot that is completely irrelevant for a variant that is long gone? (Probably-- it is the govt after all.) I'm honestly thinking about just quitting now, and taking my paltry retirement and telling them to stuff it. I've lost the will and energy to fight these morons every step of the way. They think the shot "works," and even Fauci shouting at them that it doesn't work anymore won't change their stupid minds.
My woke employer backed off a bit after Texas issued its outright mandate ban—stronger than any other state’s, even Florida. By “backed off,” I mean they accepted pretty much every one of the 5,000 or so exemption requests they received. I heard this directly from a managing director who advised on the policy.

Set up discussion groups for employees to prepare for their legal options should they experience adverse effects from the vaccine mandated by their employer. Make sure the company knows this is going on. This could turn out to be a tort lawyers dream.
I would think if OSHA mandate doesn't hold then it gives grounds for lawsuits. Besides that everything out there like injections, tests are Emergency Use Authorization. At least a month ago, all I got from work was that it was "the mandate". People don't like getting questioned. More reasons now to keep questioning.

The medical freedom folks warned the medical workers YEARS ago not to give in to mandated flu shots. We begged them to join us and fight it. Instead they rolled over and took it. They made their bed and now they have to lie in it.
Hospitals will not receive federal funding unless 90% of their staff (even the IT guys) take the flu shot each year. Your local doctor? He has to have something like 63% of their patent population up to date on adult vaccines (the elderly population) or their Medicaid and Medicare reimbursements are lowered. Before freaking out over the CMS decision, it is important to understand the posture before the Supreme Court. The Court was being asked for a "stay" which requires a very high probability of success on the merits. Now the case goes back to the lower courts for hearings on the merits including constitutional issues. So stay tuned.
Good point. And the longer Omicron rampages, and the more time for the New Narrative to gains ground, the less important these mandates become. I think Biden wants the Pandemic Genie back in the bottle, but that's going to take some really creative work.

It's a good thing that they RULED the 'right way', in principle at least, but it does little to ensure people follow it. What I don't understand is how unconstitutional precedents seem to be uncorrectable. Until I start to see these decisions - like the mother of all: Wickard v Filburn and it's bastard offspring Chevron Deference - reversed, I don't see much positive in any of these "wins".
Courts, IMO, must start making Constitutional principles the core of their decisions. Until then, we are a government of men, not laws.
The only solution is a constitutional amendment protecting the right to bodily autonomy. The Govt shall make no law that interferes with an American's right to accept or deny any medical treatment.
Of course now is not the time to do that. Public support for vaccine mandates is still pretty high. But as time goes on and more breakthroughs happen, followed by ongoing booster mandates, public opinion will shift.

The hospitals that required the flu vax would allow deniers to wear a mask (like a scarlet letter), however, it wasn’t required in EVERY healthcare entity & one could pursue a healthcare position elsewhere. With THIS madness, the whole healthcare system could come to a crashing halt. Now, I ask...since this is all in the name of “patient safety”...where does that leave patients? I hear some restaurants are using robots to help with staffing shortages. Maybe they can get a few DocBots or NurseBots to care for patients. They’re gonna need something because the future doesn’t look good with impending delays in care. Thankfully, my place of employment “granted” me an exemption, but what if I wanted to seek employment elsewhere? Or work per diem in a hospital? I won’t get hired.

Im just at the cusp of leaving my partnership practice here. I am an equity partner and I have a whole life built here in NNJ. BUt Im sick of it. I am maneuvering to retire and bow out gracefully . Us liberty minded sane rational people have to try to create parallel structures. Im trying to work with the AAPS and frontline doctors to create medical facilities that dont participate in medicare. Medicare is unconstitutional and bankrupt anyway. The seniors who value good medical care will start to abandon medicare providers.

Absolutely. The silver lining to all this is that governments around the globe are behaving so ridiculously that more and more people are waking up to the reality that government is fundamentally broken as an institution and can’t possibly accomplish the mission it purports to, no matter how benevolent and well-intentioned its leaders may be. It’s certainly not obvious, however, whether it would be more likely for us to be able to somehow put the toothpaste mostly back into the tube (in the form of a government more in keeping with the original design of our Constitution) or if it would actually be easier to convince our fellow citizens that freedom and markets will solve society’s problems better, quicker, and more fairly than central planners. I tend to agree that it will be the latter, only because I think a complete collapse of existing systems will be necessary to motivate the masses to make such sweeping changes. The unfortunate reality (aside from the chaos which always accompanies such transformations) is that we don’t know that it would ultimately result in a smaller (or zero) government situation. With the amount of socialist mind poison being forced onto today’s young people through public education and the capture of academia, they could just as easily conclude that it was “unrestrained capitalist greed” responsible for the collapse in the first place. Sadly, the lesson may actually be impossible to learn.

I heard an RFK Jr podcast over the summer where he was talking with another experienced lawyer. They said it is very difficult to win a case based on the US Constitution. They gave an example of something that was unconstitutional but instead they sued and won on it being against the California State Constitution which is more detailed. Then lawyers in other states modeled (or could) lawsuits off theirs.

Nor do you read an authorization for the creation of CMS, HHS, HEW, or the Secretary, Medicare and Medicaid programs. If the Court judges that the Secretary does have Congressional authority to issue this rule, then wouldn't it follow that the Court assumes his Department and its programs are also Constitutional? That question wasn't argued by the Plaintiff, et al.

I think this expedites the creation of a bifurcated health care system ala England. Hospitals are effectively government run now. Car accident - go to a hospital. Overall healthcare - go to private doctors, for those who can afford to do so.

Most but not all. Functional medicine docs don't push meds and look discover and treat the underlying cause. They are small in number but growing.

I'm a federal contractor and I was told 2 hrs. ago that the rulings doesn't apply to me, testing and mask wearing and possible forced vaccination is still in full force, so this isn't over by a Longshot.

The problem is that, even absent a mandate, these companies can continue to make up their own nonsensical rules. This was always about coercing private business into doing what the Federal Government can't. They knew that businesses would have to begin taking steps to comply with their arbitrary timelines, and that people would be forced into doing things they knew weren't right for them, even though these mandates were never more than press releases.

Here in Maryland, our governor is doubling-down on his emergency orders and stoking everyone's fears. I assume the striking down of the OSHA mandate simply leaves it to the various State governments to support employer-mandated vaccines.
Something I haven't seen mentioned lately; these vaccines are still experimental/EUA. How can any agency or employer legally mandate these despite acknowledgement that they do not prevent infection or transmission? Even if we 100% believe the "somewhat reduces severity of symptoms" approach, that doesn't fit into a public health crisis to support mandates.

The other thing Jeff didn't address (and I assume he will after he gets out of his drafting haze) is that the OSHA decision only lifted the 6th Circuit's decision to lift the stay that was put in place by the 5th Circuit. So in essence, it seems there is still a battle to be fought in order to get the 6th to agree w the 5th.

I work at a college and I think students should withdraw from any college/university that requires this and find another higher learning institution that respects freedom and privacy. They need to start feeling it financially. If enrollment numbers start decreasing and they miss out on the $$$ maybe they will rethink their policies. The funny thing is at the college I work at, they are scratching their heads wondering why enrollment keeps dropping. I wonder why! People want freedom and privacy!
Not to mention giving science a back seat to politics and virtue signaling. What most of these colleges have done is to collect non-refundable tuition payments in advance from students on the promise of normalcy, and then imposed sweeping mandates, mask policies, and lockdowns on in-person learning and social activities after the fact. It's a criminal bait and switch, and if I were a student or the parent of one, they would never see another dime of tuition from me.
They have, through a couple phases of programs, but there are stipulations regarding how that money can be used. In 2020, money flowed from the Fed spigot and was spent all sorts of ways, but subsequent funding had many more restrictions and colleges that spent it like drunken sailors are in for a rude awakening.
That is true. Our college district has received millions (not for testing, but for other initiatives). They do not want to loose that money so unfortunately, they will do what they need to keep it.

True, but he established the mask mandate across all State and public buildings, "Shared Spaces", has restricted elective surgeries, bypassed licensure requirements so that recent grads may begin practicing nursing without have to pass examinations, is crowing about Maryland performing 63,000 tests per day (when our hallowed Federal agencies are advising away from this), further pushing vaccines and boosters on children 12+ and with shortened eligibility of 5 months post-last jab.
His FB statement regarding not supporting broad mandates rings hollow, especially after ramping up the very things that even Narrative 2.0 are admitting cause more harm than good, or at the very least provide no benefit.
I agree I was just being hopeful about him not supporting vaccine mandates for businesses. I def don't agree with all the other things he is doing for sure specifically encouraging kids to get vaccinated.
After reading and ruminating some more, it feels like even with the OSHA mandate we won the battle but lost the war. My employer and likely many others went ahead with implementation of the mandate and even with the decision there is no sign they'll walk it back even if there's no OSHA penalty for not complying. It appears that there's nothing in the decision requiring them to back off, and there appear to be provisions like "crowded workspaces" where a mandate might be upheld. It's also disappointing that there's no reference to actual statistics on efficacy even as the EU, WHO, Japan etc. are now realizing there's something amiss - perhaps a topic for future legislation or court decision?
There are two important wrinkles to this- one that you'll probably like more than the other, but neither of which are too bad. They're like Taco Bell farts in a car as opposed to White Castle farts in a freight elevator going up to the 60th floor.
Uno, when OSHA was initially happening, it looked likely to fail based on EMPLOYER LIABILITY ISSUES. At first, OSHA explicitly stated that if an employer mandates vaccines and those vaccines hurt/kill an employee, THAT EMPLOYER IS LIABLE with precedent from other workplace mandate injuries, like getting helmet-head.
With OSHA entirely removed from an employer mandate, there's no buck to pass- the employer is wholly responsible for their own standards. This means a couple of things are likely to happen to employers who just love wearing brown and maintain their "own" mandates after OSHA goes away:
1) lots of lawsuits when (not if) an employee dies or is critically injured by a vaccine. They may not all win, they may be hard to prove in court in this climate, but there will be a tsunami of them, and that's enough risk to make risk-averse woke-shilling corpies back down.
b) this is the one you may not like as much- companies make their mandates and freely enforce them and they're bullshit and there's no protection or liability, just like now. But here's the silver lining: this allows market forces to take over. We all move in different circles, but I've heard plenty of stories about people walking out of interviews after the subject of vaccine mandates come up only to get better jobs elsewhere at places with no mandates. It's already happening because of the CMS mandate, no matter what the future of it is: healthcare workers are moving all over the country to find more receptive environments.
A Great Sorting is underway, and while it sucks a lot that people may find themselves needing to uproot their families and move away from tyrannical states and localities (yours truly included), it will quickly impoverish the businesses and areas that double down on tyranny.
I hope this makes you feel a little better? There's no question that resisting this tyranny will be uncomfortable and require sacrifice, but the current legal climate at least still makes it possible to do so peacefully.
Exactly -- the "free market" may sort this out in time, if the gov't stays out of it. If United has a vaccine mandate, but Southwest doesn't, pilots can change jobs. Over time United loses, faces litigation, and in the end will probably forget about it's mandate. If California is crazy, people will leave. We've got a big country here, thank God. Now, over the next 100 years, the states might become so different that the United States can't hang together anymore, but that's a whole different can of worms.
To be honest, that's exactly what I see happening, but at least in that way it comes about by regular people making choices and not a tyrannical government succeeding in controlling the minute movements of every man and woman.

The question is, who poses the biggest financial risk. Take banking: JPMC is used to being sued by employees. They quietly write checks. What’s the most they write, $10M? But the Federal govt can really stick it to them. They can prosecute for years as a DPA, they can cut them out of Treasury auctions, Discount Window funds, State and Federal pension funds, investment banking deals. Literally billions of $.
But now the Fed has nothing to stick it to them for. Imposing employer mandates is no longer handed down by Brandon fiat. Until things get a lot worse, you can't literally force people to work for you.
I agree with this. I was initially happy when I saw the headline, but after I digested it, my heart sank a bit. I work for a woke company and this doesn’t block them from moving forward at all, in fact, I bet they double down. Their pride and arrogance will have them pushing forward with this madness.
Then people like you need to go work somewhere else for an employer that- now that they have the choice- chooses not to implement mandates. It's the only way the double-downers will be hurt.

Have you tried requesting an exemption? It at least delays things. I've applied for a religious accommodation at my job (Fed govt) back in November -- crickets from them so far. Will they grant it? When? Will they deny it in six months and try to make me take a shot that is completely irrelevant for a variant that is long gone? (Probably-- it is the govt after all.) I'm honestly thinking about just quitting now, and taking my paltry retirement and telling them to stuff it. I've lost the will and energy to fight these morons every step of the way. They think the shot "works," and even Fauci shouting at them that it doesn't work anymore won't change their stupid minds.
My woke employer backed off a bit after Texas issued its outright mandate ban—stronger than any other state’s, even Florida. By “backed off,” I mean they accepted pretty much every one of the 5,000 or so exemption requests they received. I heard this directly from a managing director who advised on the policy.

Set up discussion groups for employees to prepare for their legal options should they experience adverse effects from the vaccine mandated by their employer. Make sure the company knows this is going on. This could turn out to be a tort lawyers dream.

I would think if OSHA mandate doesn't hold then it gives grounds for lawsuits. Besides that everything out there like injections, tests are Emergency Use Authorization. At least a month ago, all I got from work was that it was "the mandate". People don't like getting questioned. More reasons now to keep questioning.

The medical freedom folks warned the medical workers YEARS ago not to give in to mandated flu shots. We begged them to join us and fight it. Instead they rolled over and took it. They made their bed and now they have to lie in it.
Hospitals will not receive federal funding unless 90% of their staff (even the IT guys) take the flu shot each year. Your local doctor? He has to have something like 63% of their patent population up to date on adult vaccines (the elderly population) or their Medicaid and Medicare reimbursements are lowered. It’s not about health, it’s about money.

Before freaking out over the CMS decision, it is important to understand the posture before the Supreme Court. The Court was being asked for a "stay" which requires a very high probability of success on the merits. Now the case goes back to the lower courts for hearings on the merits including constitutional issues. So stay tuned.
Good point. And the longer Omicron rampages, and the more time for the New Narrative to gains ground, the less important these mandates become. I think Biden wants the Pandemic Genie back in the bottle, but that's going to take some really creative work.

This is probably the most important issue most of us will ever face as adults. And they once again proved that they are NOT WORTHY. Where is the 9/0 condemnation of state coercion. Where is the unanimous strident rebuke of an overreaching executive and the scolding of the tantrum throwing masses. Does the state or ANYONE have a compelling reason to force someone else to take an experimental drug? The question is obviously NO! ANd the answer in this case is plain and simply NO NO NO. Particularly in light of the facts in evidence. That the vaxxes are not sterilizing and COVID is not really that dangerous to the vast bulk of the people. So once again the court has revealed itself as an utterly political captured corrupt failed institution. Roberts in particular and now Kav should be ashamed of themselves. The three liberally minded judges are beyond shame, thats why they probably were chosen. Im even more disgusted than I was when the affordable care act was passed or when PFizer was allowed to steal Kelo's house.

This SCOTUS decision 'has no teeth', to use a phrase often used by lawyers in cases like this. It's a good thing that they RULED the 'right way', in principle at least, but it does little to ensure people follow it. I know many nurses are complaining that while this decision looks good, it doesn't apply to them so it's a disappointment. I just wonder, did they know that when they made this call? I.E. is it an appeasement of people like us, knowing it will change absolutely nothing in real terms? We are being played in so many ways since this Covid BS started, I have to question everything now, even my wife's cooking!
