In doing settlement estimates, our attorneys don't feel comfortable relying on historical values due to the massive awards handed out in the past few years for med-mal suits. Recent conferences have warned defense attorneys to set their reserves much higher in cases than they are used to. Personally, I think the general public is angry and awarding plaintiffs large figures is a way to show their anger - especially in med-mal suits.
