"Justice Thomas was Judge Cannon’s law clerk."

Judge Cannon was Justice Thomas's law clerk. Regardless, outstanding round-up. I am particularly grateful for your rational breakdown of the Trump decision. I kept shouting, "That's not what it means" as local liberals were plunging to their death from nearby bridges and tall buildings.

T Kosse's avatar

At first I thought Jeff made a mistake too. But then I realized he was saying Thomas was acting in the way a law clerk for Cannon would act, i.e., providing an outline and script to knock down Smith's position.

John Cougar Misanthrope's avatar

Thank you. So much for my knee-jerk attempt at humor. I knew Judge Cannon was super-smart in law school and a law clerk, so I just assumed.

From Wikipedia: "From 2008 to 2009, Cannon served as a law clerk for Steven Colloton, a judge on the United States Court of Appeals for the Eighth Circuit in Iowa."

ThreeArchBay's avatar

She may have put herself into the running for a SCOTUS seat...

Brian Lombardi's avatar

Maybe we can convince Barret to step down and replace her with Cannon

Mary H.'s avatar

ACB has been such a disappointment.

ThreeArchBay's avatar

True... but, of course... better by far than the Sotopig, Bulldyke Kagen or token Kunta-Ketangi...

And I am not thrilled with Roberts at all... or Kavanaugh, who seems to have a decided lack in the testicular dept...

Wouldn't it be great if a President who nominated a SCOTUS Justice could also, at will... remove them? I think Koward Kav and ACB would both be gone when TRUMP returns...

Sharon Beautiful Evening's avatar

YES!! Barrett has been a HUGE disappointment!!

Just use nicotine patches and take Ivermectin at least 2X/month.

Yes, seriously.

I also use Chlorine Dioxide Solution (CDS) daily, but most have never heard of it... Big Pharma calls it "bleach".

Jlbg8r@gmail.com's avatar

More info please. I also do Ivermectin 2x a month

Gigi Gummerson's avatar

I read it 3 times and thought Jeff turned it around accidentally…I now get it 🤦🏻‍♀️

Susan G's avatar

I didn't get it until I read the comments. Vaccine injury, I presume.

Politico Phil's avatar

Yeah, I didn't get it either. I guess I'm too literal.

Sharon Beautiful Evening's avatar

Being "literal" with Jeff Childers is anathema--LOL!! His pungent wit always aces his commonality - :-)

CMCM's avatar

Well done, Justice Thomas. He has always been my favorite and most respected Supreme, but with this he has risen far and above my former high respect for him. Brilliant!

Paige Green's avatar

It was actually Biden, in Senate confirmation hearings, that caused me to latch on to Justice Thomas. I was impressed with Thomas’ fortitude in putting up with it, and very pleased he’s one of the Supremes. My hope is that we don’t have to ever go through any of that again. Ever. FJB.

Susan Clack's avatar

Ahhhhhhh…the light dawns…excellent post! 🌅😱😎

Garden Lover's avatar

This is how I read it as well.

Irunthis1's avatar

I think what he meant was that Justice Thomas just wrote her decision for her, much as a law clerk would do. Here’s to hoping she grabs it with both hands and flings it in agent smiths face.

Bandit's avatar

Agent Smith. Oh! The irony! (The Matrix, for those that shun Sci-Fi.)

Irunthis1's avatar

Jeff said it first…and there IS that photo of Agent Smith in the article…I just agreed that we should (from now on) refer to the man as such since he’s certainly NOT a “special prosecutor “ in the legal sense of the term.

Oh! If only they were plunging to their deaths. I am soooo tired of their self-righteousness. The everyone is stupid and always wrong, just never them. We deserve punishment for the least little thing, but they are above the law. All the while they are behind bringing down our country.

AngelaK's avatar

They have voided their hearts and souls of God, and in its place, demonic, illogical hysteria has implanted itself into their hearts, minds and souls.

I see their hysteria (usually over abortion, alphabet, and sexual themes) as demonic possession.

Coretta Scott King once said: "When the heart is right, the mind and body follow".

(notice how the left has become so demonic that they don't even like Martin Luther King anymore because his words are too logical and spiritual).

I am not understanding how all those posts weren't taken down as hate speech. Can the one CA rep be charged with inciting an insurrection?

Jeff C's avatar

Because hate speech is a totally made up concept that criminalizes people's thoughts. It's not real thus it's only applied in one direction.

There are already laws against threating to kill people.

Bandit's avatar

Nothing is hate speech when it comes from a dumbocrap.

Peter GL's avatar

Bandit's avatar

Thank-you. I made it up many, many years ago. It describes them pretty well.

IF it was a conservative threatening assassination... the FBI would be visiting them the next day, if not within hours... with a CNN camera crew...

John Cougar Misanthrope's avatar

If it was a conservative talking about the assassination of Archduke Ferdinand in a lecture at Hillsdale College, the FBI would be paying a visit.

Bandit's avatar

They've been talking assassination for awhile now. Way before this decision. I think it's been their plan all along.

John Cougar Misanthrope's avatar

All eyes on Judge Merchan.

I'll also be watching my neighbor with the 'yuge Trump and Gadsden flags who spends the weekend shooting AR-15s with his sons on his farm. Having come from Michigan, I remember the stories about the Nichols brothers blowing up things on their farm in Howell (the Michigan version of the deep-south) with their buddy Tim McVeigh. Very scary times we live in and I tend to agree with Tucker Carlson that supernatural things are afoot.

DEBORAH E. dds's avatar

very supernatural. Acts2: 1-3 ‘And it shall come to pass in the last days, says God, That I will pour out of My Spirit on all flesh; Your sons and your daughters shall prophesy, Your young men shall see visions, Your old men shall dream dreams. And on My menservants and on My maidservants I will pour out My Spirit in those days; And they shall prophesy.

AngelaK's avatar

I read this as spiritual awakening.

What we are seeing is demonic possessions.

Sharon Beautiful Evening's avatar

AMEN!!! May it ever be thus!!!

Kathleen Janoski's avatar

John Cougar Misanthrope's avatar

My thinking about Tim McVeigh and Waco has changed radically over the years. I was horrified then and still am. Now, for different reasons.

Sharon Beautiful Evening's avatar

Actually "supernatural things" have been 'afoot' since prehistoric times...we just have more "media mites" jumping on juicy tidbits of 'news' now than ever before in human history.

Bandit's avatar

You sound a tad paranoid.

John Cougar Misanthrope's avatar

I am a tad paranoid. Joe Biden is president. Taylor Swift is ubiquitous. How did that happen?

Roger Beal's avatar

When they actually ARE out to get you, you are not paranoid. Just a realist.

Curious Jane's avatar

Not just talking - I have read of several attempts, if the accounts are credible.

dont they have some SERIOUS security, those guys? as a result of those threats?

Sharon Beautiful Evening's avatar

Because the legislative branch of our Federal government is filled with MORALLY COMPROMISED 'leeches' instead of true Constitutionally sound 'legislators'!! They're ALL IN ON IT!!! There are a few "beacons of light" (like the Freedom Caucus legislators)...but they are very few and far between.

KarlM Alias's avatar

A 'vaccine' syringe does have a plunger, so there's that.

rolandttg's avatar

But they should, because I also saw what this meant to previous demon presidents, like the Shrub, Obongo, and Slick Willie. They should be shaking in their boots. As should Biden, if I believed he was actually still alive.

John Cougar Misanthrope's avatar

Great point.

I just ran to my local DEI-free Tractor Supply here in Middle Tennessee to buy a large placard and paint. I'm putting a sign next to the Tennessee River overpass that reads: "Free Money for Neocons" with an arrow pointing downward.

Roger Beal's avatar

Post a photo of that sign here in the comments, plz.

Sharon Beautiful Evening's avatar

Tell me, someone please...when did the "military/industrial complex" morph into the term "neocons"???

John Cougar Misanthrope's avatar

I like this explanation from a post by Thomas Gallagher on Quora:

"Conservatism is a political philosophy that values tradition and established practices over social progress and new ideas. This isn't saying it's purely reactionary; anyone who believes recent developments in a particular area were harmful and should be reversed could be considered conservative in that area, e.g "I hate how cellphones have destroyed face-to-face communication!" In the United States, conservatism has traditionally identified with keeping with the spirit of the Founding Fathers; limited government, non-intervention in foreign affairs, a free market, and strong personal liberties.

Conservatism typically switches between parties; depending on the time, the coalitions they build, and the ideas that are popular. Now, Republicans are considered more conservative, but that wasn't always the case.

Neoconservatism (and the older conservatism, now called Paleoconservatism) represent an offshoot of conservative thought that emerged during the Cold War. Since Communism, the antithesis of all conservative ideals, seemed to be rapidly growing in strength during the 50's, many Conservatives began to question the wisdom non-intervention in other countries, a school of thought already badly discredited by World War II. Their brand of "New" Conservatism placed great weight on the strength of the military, the interaction of industry and the government, and a powerful investment in industry and science. As a result, many tenets of Paleoconservatism (older conservatism) were dropped; Government spending vastly increased, personal liberties were tempered with security concerns, and many wars and coups were started in the aim of increasing American power, although a strong moral puritanism remained.

Neoconservatism reached its peak under the administration of George W. Bush, but became deeply unpopular as a result of the Iraq War and the financial meltdown.

So to wrap this up,

Conservatives: Back to Basics (Tea Party)

-limited government

-restrained spending

-moral values

-free market

-smaller military

-strong personal liberties

Paleo-Conservatives: Democracy with a Heavy Dose of Patriotism (Most Republicans now)

-limited government

-restrained spending in theory, often deficit spending

-moral values

-free market

-strong military

-certain liberties emphasized (Strong moralist streak)

Neo-Conservatives: America the Powerful

(Cheney, Bush, Reagan)

-big government

-deficit spending

-moral values

-military-industrial-financial complex (big business)

-strong and very active military

-heavy government surveillance, strong police

Basic overview, enjoy!

Great comment. I particularly appreciate the additional perspective. You have offered much to think about and truly consider.

AngelaK's avatar

The Clintons ushered into our culture and society, the demonic element, fully pushing Christian values and morality aside for good.

I think we can look at things as BC ( before Clinton) and AC (after Clinton).

Curious Jane's avatar

No, it was here well before that. Before 1871 and the Organic Act. Before Abraham Lincoln was assassinated. Those forces were hard at work. But - they Are a lot more obvious now, less lurking-in-the-shadows.

AngelaK's avatar

Perhaps but what I meant is that our culture went through a fundamental and obvious morality change..I remember it clearly through television (everyone was having sex from the older ladies on Golden Girls to Frasier) and pop music took a sexual turn . Religious observation was being replaced by Sunday morning sports practice for children, brunch or jogs for adults. (I remember my Priest being upset about that.) Church going, Sunday school, was no longer the 'thing to do'. Clinton was talking about his wife's necromancy practice of communicating with Eleanor Roosevelt as if it was something everyone did. And his WH antics...

no one will forget, especially the children who were exposed to it and according to a middle school Principal I knew, emulating it behind the bleachers in groups.

Soros started buying up journalism schools and media outlets after Clinton in 2003 and the NWO agenda was in getting a foothold. The next year, the EU consciously removed all mention of its Christian foundation from its constitution.

All this on the surface. God only knows below the surface what was going on.

Definitely appreciate the summaries today on the various rulings. Still not crazy about the free speech and private orgs being influenced by the government ruling, but the rest are pretty good. I figured the "partial immunity where it makes sense in a sane world" ruling would be the way it came down. You couldn't rule "absolute immunity" nor could you rule "it's all fair game". You have to have the balance there and that _is_ a good thing.

The concern now is all of the nuts out there trying to claim the current admin could order drone strikes to take out Trump (or other political opponents) and do so with completely immunity. Those people are really concerning because they walk among us and genuinely think that's a good idea. These are all some great rulings, but just like we're seeing in France, we're ramping up for another "Summer of Love" type of insanity. :(

Now to see if courts start (or continue) ruling for people affected by the OSHA mandates and such. I saw the TN award for nearly $700k for one person, which I expect will be challenged and reduced, but that's the first case. We can only hope that this trend will start going far and wide. Companies should have taken a long look at what forcing their employees to take untested medical interventions would do to their bottom line.

Irunthis1's avatar

I know my company thought that far ahead. I was able to fairly easily obtain an exemption for myself and multiple co-workers. They really only required that you ask for one. And, while not a hospital or medical office, it is a pharmacy with direct patient care giving covid shots (which I also did not do). But there were pharmacists who DID give the shots who were exempted as well so…. While I know they only did so to prevent a shortage of pharmacists (which they certainly would have had if they had denied) I was eternally grateful to have been able to keep my job as there was no force on earth able to make me take that shot.

Broke radius messily Fri. a.m. Saw surgeon yesterday. Wrote, in shaky handwriting, w. signature: no allografts, no xenografts, only autografts, no mRNA products, no blood transfusion from any but husband. Said to P.A. these words: I would rather die than take Covid-jab-tainted blood.

Jeanne's avatar

We wanted to “bank blood” for our mom during the height of the vax insanity (because we did not want her to have tainted blood either). It was not going to be an easy process by any means! So for anyone concerned about transfusions, I would research well in advance of any planned surgery what you need to do! Thankfully, my mom chose not to have the surgery so it became a moot point.

Fred's avatar

Autologous donation was the way to go before an elective procedure even pre-jabs. Seems to be more resistance to that approach now; well, except for the ortho docs.

ViaVeritasVita's avatar

Jo's avatar

I second what Jeanne said re: researching this well in advance. We looked into banking my daughter's blood before an elective surgery, and it's a paperwork nightmare that has to be started months in advance.

Fred's avatar

If you push hard enough, and have a cooperative doc, it can be done in as little as 3 weeks. Contact your local blood bank directly for assistance! (Just don’t mention unvaxxed blood.) Everyone knows it’s safer to use you own…

Aloha, Irunthis1! Can you share the name of your company? I’m an attorney representing employees fired for requesting a religious accommodation from the Covid vax. Generally the employer denied the accommodation on the basis of a purported undue hardship, that being the unvaxed were an alleged threat to others. But being able to tell the court that many companies- including those providing healthcare - granted accommodations can help to beat that dubious defense (indeed, even the CDC granted hundreds of accommodations and did not fire any of its employees who requested accommodations). If you’re comfortable doing so (I would not use your name, just the name of the company) feel free to email me at joegomesesq@gmail.com. Thank you in advance!

My husband was granted a religious exemption from the City of Milwaukee. Very grateful to Jeff to this day for helping lay out the format for us on this blog.

Patty's avatar

Consider using Conscientious Objector instead of Religious reasons. It indicates a thoughtful, rational decision to decline the vaccine. It would benefit those who don't have a religious belief.

Irunthis1's avatar

I went with religious because of the stronger laws on the books in my state with regards to exemptions. I wanted to do a medical but so many doctors were just playing along and screwing it up for everyone who had legitimate medical concerns--e.g. telling people who clearly had a severe adverse event to get another dose or telling people with anaphylactic reactions they had to get one anyway---completely insane advice. So religious made more sense.

Patty's avatar

Curious which religion provides that exemption.

Irunthis1's avatar

Well I’m catholic but there is plenty of doctrine out there that one can be a conscientious objector of something the church says is okay. Here is an example from a catholic organization of such a statement:

That's great news! Someone won a law against a company forcing the shot on them? I didn't see that. This would be a great start towards ending this madness permanently. Companies need to be sued to kingdom come for forcing shots on employees.

I can only hope that her attorneys fees were not 50% of the judgement. Any judgement such as this where a monetary reward is for lost wages should include an award for attorneys fees so as not to further harm the person who won. Not that I wouldn’t want her attorney paid mind you, it just doesn’t seem fair that she should have to be out that money since she wouldn’t have needed an attorney but for the negligence of BCBS.

LamedVav disavows all vaxes.'s avatar

Attorneys have bills to pay. Attorneys deserve huge fees in these kinds of cases, in my opinion.

They have to pay in front as a loan to the client for all of the expenses of the case, in order to win it. Filing fees, court, reporter fees, secretarial fees, jury fees, and on and on for thousands and thousands of dollars advanced on behalf of the client.

laura-ann Knox's avatar

I don't think 50% is excessive. . . . Sure the client needs money, but to get a lawyer to even TOUCH this case. . . Very brave and trusting of the lawyer to do that

Fre'd Bennett, MAHA's avatar

Especially since every lawsuit is a crapshoot. I've won cases that I thought were unwinnable, and lost cases I initially thought were unloseable.

NAB's avatar

Typically, though it does vary, plaintiff attorneys reap about 30% of a settlement or jury award. See Lamed's excellent comment.

Carlos's avatar

But also without that attorney taking the case when nobody what’s wheeling it could never had happened.

These people will comprise the jury pool pretty much everywhere.

Obama and previous Presidents need to be worried?!

Neil Kellen's avatar

Obama should be worried because he executed an American citizen without due process.

Steenroid's avatar

I was thinking that that would fall under Tier 1 but I don’t remember Congress declaring war.

Neil Kellen's avatar

The Constitution requires due process for all US citizens, regardless of context. I understand the exigent circumstances but the law is crystal clear on this issue. Obama broke the law.

Roger Beal's avatar

The Lightbringer broke many laws, virtually every day. And also violated his oath of office on multiple occasions.

richardw's avatar

Should Trump be worried because he executed the Iranian general? Were we at war with them? Should all the swamp creatures just following orders from above be scared? I mean if the president is culpable for acting outside his constitutional authority is the person pulling the trigger in trouble? Nuremberg court says yes. Is Hillary culpable for killing khadafi? Was she as part of the executive branch allowed to order a foreign leader of a country we are not at war with executed? One more point, will there be any legal prosecutorial entity with ‘standing’ be willing to go forward? This is literally pandora’s box and maybe they all want to just say “never mind “ to the Trump stuff and just get back to the business of government (handouts to power); renew that gentlemen’s agreement regarding presidential privilege

Fla Mom's avatar

A Pandora's Box that leads to, maybe, we only go to war when Congress declares it? What a concept. George Washington would approve, I think - "avoid foreign entanglements."

liz's avatar

LOVE LOVE LOVE THIS COMMENT.

Neil Kellen's avatar

The individuals you referenced were not US citizens, so, at least from US courts, there should be no worry. Internationally, you may be right.

As far as standing, I think it may only be DoJ and it will only go after political adversaries, most likely. Ugly, but expected.

I do agree they should just forget about all the Trump stuff (state and federal, decided and still active) and renew the gentlemen's agreement.

This all started in November 2016 when Dems and liberals refused to accept a Trump victory. Since that time, they have been at war with the US - how dare we elect someone they don't like and/or can't control.

The book, The Fourth Turning, explains how it will get crazier until it starts to get better (inception of the First Turning). We are getting close. My guess is, we aren’t too far off, as these cycles tend to be in the 80 year range and this one is long in the tooth. I believe that is due to Hillary losing in ‘16 and having the brief glimpse of “what could be” aka prosperity and peace, before the lid slammed shut again. Even so, I think this Turning will come to a head very soon. Popcorn indeed!

Roger Beal's avatar

Who will write and pass a law prohibiting Congress from employing lobbyists from writing draft legislation?

Aodoc's avatar

Yes, that censorship case was hard to take now but I think that will be worked out in the future when we address and define publisher vs. platform issues. It is not a done deal. But those that censor can suffer from decreased use and other entities replacing them that do not censor. We see this happening already. We see all these nincompoop talking media heads losing their minds because they are losing control. I tell my 26 yr. old son although some of this is hard to watch and live through, we are living through a time in humankind that shows us how big God is. This was a jury award. We are finding in the legal world that juries are highly unpredictable in the post-Covid landscape and tend to award much larger verdicts. In doing settlement estimates, our attorneys don't feel comfortable relying on historical values due to the massive awards handed out in the past few years for med-mal suits. Recent conferences have warned defense attorneys to set their reserves much higher in cases than they are used to. Personally, I think the general public is angry and awarding plaintiffs large figures is a way to show their anger - especially in med-mal suits.

Instead of doing what so many did, (frantically investing in Pharma stock to benefit a windfall from those doing despicable things,) we should all consider investing our money in a law degree to benefit from the windfall of those doing what is right. I’m almost 60, can it be done at my age? Can someone my age find a job afterwards without any prior related experience? I feel like it would be money wasted since there are those in the age brackets of 25-50 to compete with and we live in a country that rarely values those of older age (unless they are in government of course.)

Oregon Kathy's avatar

Much easier to 'come alongside' an org that is doing just that. Volunteer your time or get enough education to be of use to them.

Yes and I would enjoy that if I didn’t need to earn money as badly as I need to. Volunteering doesn’t pay our mortgage or buy us food. I’m not blessed with resources the way I should be at this juncture of my life, because of our economy and the tax laws hurting the lower middle class so badly. They never stop to think of the trickle effect, how it robs our society of those that could and would have volunteered more if their years of hard work and wise financial planning actually did what it was supposed to do. It didn’t. I need a paycheck. But I want my work to matter and support goodness not selfish greed.

I wonder if all the rage is really about their fear that what they started will come back to haunt them. They tried a former president, which had never been done. Then SCOTUS said sure, you can do that, but you must pass this three tier test. "Before you pass this bridge you see, answer me these questions three."

We have this supreme court because Harry Reid chose the nuclear option. One of the defining characteristic of children is that they lack the ability to imagine what consequences might result from their current actions. I think when choosing hyper lawfare against Trump they weren't thinking about any future consequences. The long game is well worth playing if you play it well.

Jason A Clark's avatar

We give them credit, usually rightfully so, for playing the long game especially involving cultural issues. But over the last few years it's seemed more like they're burning everything down with no thought for the future.

In some ways, it's like an NFL team that feels they're so close to getting to and winning the Superbowl that they put everything, even mortgaging their future, to win RIGHT NOW.

I think they felt like they were so close to winning it all and having permanent, total control that everything could be justified in that light. Win, and nothing else matters. That also explains why every setback for them is cataclysmic and world shattering. They CAN'T lose. They've broken the rules and destroyed the processes going all in. If they lose, there's nothing left for them.

Which makes them even more desperate and dangerous.

Angus McPherson's avatar

Right Jason. Love your 'about to win the superbowl' analogy. Really fits.

Your final sentence really struck me. Desperate and dangerous indeed. We should be on our guard. A cornered animal is much more dangerous, and this beast is backing itself into a corner.

Heterodox Introvert's avatar

Re IRS, the collection agency for the Federal Reserve which is a private company:

No surprise, 26 U.S.C. (the federal income tax code) is written with obfuscating legalese. In a Jeff Childers spirit, a dogged legal scholar named Peter Eric Hendrickson unraveled the tax code as it applies to ordinary Americans. Twenty years after its first printing the author made his book 𝐶𝑟𝑎𝑐𝑘𝑖𝑛𝑔 𝑡ℎ𝑒 𝐶𝑜𝑑𝑒: 𝑇ℎ𝑒 𝐹𝑎𝑠𝑐𝑖𝑛𝑎𝑡𝑖𝑛𝑔 𝑇𝑟𝑢𝑡ℎ 𝐴𝑏𝑜𝑢𝑡 𝑇𝑎𝑥𝑎𝑡𝑖𝑜𝑛 𝑖𝑛 𝐴𝑚𝑒𝑟𝑖𝑐𝑎 available to read for f*ree on his website. https://losthorizons.com --

The exploration of the book and supporting info on the website is like a university course. It all takes time to examine, verify if you choose (personally, after my initial 10 hours or so of verification all checked out I gave the author the benefit of the doubt on the rest; your mileage may vary), and learn enough to implement, including -yes, crudely expressed here- ensuring you've got yourself a pair to withstand pushback from the bully agency. On the website there's lots of support via examples of how to handle those people (you do ultimately deal with people, albeit a type with an inflated sense of power; you must stick to the facts). --

Bottom line, your new education will inform you that most ordinary Americans do not have a federal income tax liability. Armed with the proper factual information you can alleviate yourself of this burden. If you think this sounds fanciful, know that some people do not pay federal income tax.🙋‍♀️ Right here in C&C comments section, a few months ago a commenter posted about her success getting a full refund on what she had erroneously paid to IRS: you must scroll to comments by @𝗣𝗲𝗴𝗴𝘆 𝗕 on this page: https://www.coffeeandcovid.com/p/radio-free-america-wednesday-april/comments#comment-54207972 --

Another supporting example from an informed, ordinary American: https://www.youtube.com/watch?v=pB8IUKpxqJ0 --

It's a journey, this thing with historical misinformation and propaganda cowing Americans into paying what they do not owe. Take your time absorbing and assimilating the correct information. When you succeed in your efforts you may want to share in your own way. There will be many who will choose to remain cowed and afraid; there may be others who will see the light. --

Brightest blessings.

I’m no a lawyer, but it is my understanding Chevron applies in cases where the laws passed by Congress contain ambiguity where agencies and, by extension the President, then create regulations that interpret the law and become enshrined in the Code of Federal Regulation and sometimes run amok in doing so, even though, under Chevron, the agency interpretation was supposed to be “reasonable”. I don’t think it applies to income tax in general or specific tax rates, or allowable deductions because those are enshrined in the law as passed by Congress, but it would apply when the IRS creates rules and regulations to interpret complex tax laws. I think it basically means Congress needs to get their act together and ensure the legislation they pass is explicit and clear rather than relying on agencies to draft clarifying regulations. Chevron has only been in existence since 1984.

I have seen an argument that if Chevron is overturned that Congress will simply pass a law giving the agencies the specific authority that previously existed under Chevron.

One other thing to note, this is on a go forward basis, I don’t believe it nullifies anything that has been settled under Chevron in the past.
