The wonderful 5th Circuit Court just made a ruling that should make us all happy: https://justthenews.com/politics-policy/energy/federal-courts-pass-down-decisions-impacting-home-appliances-renewable . From the Just the News article:

The U.S. Court of Appeals for the Fifth Circuit Monday sided with 11 red states that sued the U.S. Department of Energy (DOE) over its promulgated efficiency standards for dishwashers and washing machines, ruling that “it is unclear the DOE has any statutory authority to regulate water use in dishwashers and clothes washers.”

The court also stated in its opinion that, even if it does have that authority and the agency had water-usage authority over these appliances, it failed to consider the “negative consequences” of the standards, which would have the opposite effect of their intent.

“The administrative record contains ample evidence that DOE’s efficiency standards likely do the opposite: They make Americans use more energy and more water for the simple reason that the purported ‘energy efficient’ appliances do not work,” the ruling explained.

Excellent! It’s like low flow toilets. If people flush twice there’s no saving.

Shower heads now have a flow restrictor. It makes the shower take twice as long! I remove the restrictor and flow doubles, making the shower strong enough to rinse your hair.

Well, there is one version of a Toto low flush that I swear could flush a rabbit. Sorry for the imagery and I love 🐰. I can look it up if anyone cares. Other Toto’s good but not perfect.

Probably Judge Edith Jones. She's fantastic. She was in the running years ago for the Supreme Court when the first Bush nominated David Souter. She was 2nd choice. Judge Jones was also considered by George W. in 2005 when he nominated John Roberts. We know how both of those nominations turned out. Judge Jones was seen as too conservative to be confirmed, but at least we have her at the 5th Circuit. And she probably has washed her share of dishes!

If only W had nominated anyone but Roberts. But I thank God for judges like Edith Jones. If only there were more.
