Greenwald's background as a constitutional lawyer makes his analyses on some of these legal issues worth the listen:

Thanks for posting this. I still don't understand how the one guy was not just deported, and instead he was shipped to a prison in El Salvador. Has he actually been ADJUDICATED as an MS13 gang member? Committed a crime? This is murky imho and unseemly, especially for an administration that was the object of lawfare themselves. They freed Ross Ulbricht! I understand that the Biden admin let them in by the millions and we can't deport one-by-one now, but I don't like what I see in this situation.

Number 1: He is an illegal.

Number 2: His home is El Salvador

Number 3: His HOME COUNTRY, El Salvador listed him as a member of MS13.

I don’t understand why the fake media and others do not understand this.

What else does one have to know to understand this?

Thank you for stating this in simple terms.

A friend (lawyer) posted about the legal problems with this situation. She disputes #1 so the other two are irrelevant in her opinion.

My understanding is he was told in a court of law to leave the US years ago. He appealed the ruling but did not show for the appeal so the initial ruling stands. He avoided deportation for years.

It doesn't matter. There is a legal process that the law dictates and the courts have ruled on that the government is to follow, and they are not. It is dangerous to disregard the supreme court. You would be hysterical (rightfully) if team blue were doing this.

So why was he shipped to an El Salvador prison? Are we part of the El Salvador justice system? Was he criminally CONVICTED here then extradited? If he wasn't, why not just put him on a plane to El Salvador with other deportees and then whatever El Salvador does is up to El Salvador? I'm a Trump supporter but this is skating on thin ice legally and I don't think SCOTUS will appreciate it ultimately.

As CStone said.

He was here ILLEGALLY.

He was deported to his HOME COUNTRY.

His home country put him in a prison for gang member.

I don’t see what is so hard to understand about that.

Was he not here on an asylum claim and thus in the US legally?

Look, we all know the asylum claims were *grossly* abused by previous administrations so it's hard to have sympathy for many of them. That said, the guy had been here quite a while. From what I've read and heard he was paying taxes and reporting in with immigration authorities. Whether or not that's true - I'm open to reading whatever you've got on the facts.

It's one thing for an administration to revoke the temporary residency status; it's another thing to ship deportees straight to brutal off-site prisons.

Let's pretend for a second his claims (the basis of asylum request) of fearing for his life (because of gang retribution) are true - it's not a leap to imagine that gangs control el salvador prisons and now he's a sitting duck for assassination. What if he was lawfully in the US? Now his life is over probably.

I don't know - maybe what they're doing here is technically within the law of the United States, but it sure doesn't seem within the spirit. One would think that President Trump of all people would get that. I support him deporting violent immigrants especially, but this feels and smells and looks like a mistake that was made and now there's a cover up. The cover up is always worse than the mistake and usually leads to destruction.

I don’t understand your and cnn’s concern. I really don’t. MS13 members have ACTUALLY taken over neighborhoods in this country and they rule the streets with terror, and you’re concerned over someone who is a member of a terrorist organization having RIGHTS under OUR Constitution?

The sword cuts both ways, and the Biden administration use of "Emergency" declarations empowered the Trump government to continue with the same.

So a declaration of "Emergency" to manage the Biden open invasion invitation seems proportional and appropriate.

There are responsibilities to citizenship as well as privileges, and abusing immigration laws as an opening move does not look like a commitment to citizenship.

@AM Stephen Miller answers all your concerns in this clip. It started with a holdover “lawfare” embed in the DOJ said he was “mistakenly” deported. He wasn’t. The guy has since been relieved of duty.

Thank you Seeking Grace!

Interesting, in this clip Stephen Miller himself admits that while the guy was deemed deportable in 2019, he had a 'withholding order' because of the threat on his life if he went back to El Salvador. That means he couldn't deported back to ES and would have to be sent somewhere else if he was in fact deported.

Then Miller jumps to an assertion that members of terrorist orgs don't qualify for 'withholding orders' therefore he could actually be deported.

My question is, where was he adjudicated as a member of a terrorist organization? I mean beyond govt allegations/DOJ assertions.

Also, I don't think conservatives should fall into calling everything terrorism. Slippery slope that could be turned against us at some point if it hasn't been already. This has been Glen Greenwald's argument if I remember correctly.

Anyway, appreciate the link.

He was here ILLLEGALLY!!!

He had been ORDERED TO BE DEPORTED to his HOME COUNTRY (EL SALVADOR) IN 2019.

He was NOT deported just BECAUSE he was a member of MS13, but because he was also here ILLEGALLY

Illegal is a CRIME.

It is my understanding from BUKELE that it was President Bukele who labeled him as MS13, which has been labeled as a terrorist group which has invaded the U.S. to do us harm.

So.

Did you want him to be given a warm blanket on an ultra-posh private plane to be taken to El Salvadaor, his Home?

My advice is to understand if the FAKE news networks are all lathered up about ANYthing President Trump has done? ………Then it must be VERY bad for the (formerly) msm handlers.

We sent a Salvadoran citizen, who was here illegally, back to El Salvador. Easy peasy. What a beautiful homecoming.

Libs are screeching about this because their real intent is to make Trump go insane lengths to deport each person. They know if Trump basically needs Supreme Court approval for every single deportation approximately 8 people will be sent home while Trump is President. They dont care about the rule of law. They care about power and importing voters helps them tremendously in that aim.

The J6 committee 'found' a lot of stuff too, didn't make it true. We are not the El Salvador justice system. All of the things alleged are from one side (and they could be 100% true for all I know - the point is that he wasn't convicted). Apparently, the asylum claim was based on fear of rival gangs. The rival gangs have since been dismantled due to Bukele cleaning up the country. It was a technical error to return him home and the Supremes said that if possible the White House should facilitate a return. Bukele refused. The White House can't and won't kidnap him from El Salvador where he is a citizen. Which is why the Maryland Rep is such a blowhard. He's going to go down to El Salvador and effect a jail break and smuggle an illegal alien gang member into the US? If he ends up in prison in El Salvador, maybe he can be roomies with the object of his concern.

We are, at some level, now fighting a "war" against an illegal alien invasion set up by the Biden Administration. We are working diligently to identify and deport the worst of these illegals for the protection of the U.S. and her citizens and the sovereignty of our country. MS13, and any gang-affiliated person here illegally, should be deported ASAP! In war, and in other operations, there's some unfortunate "collateral damage". Maybe this particular illegals deportation qualifies as collateral damage, maybe it doesn't. I don't care! The bigger picture is the point, and our efforts to clean our streets and country of violent threats to society is what I support and I hope all U.S. citizens support. I can feel bad for victims of collateral damage while still supporting the greater good. This is not isolated and, IMHO, should not sideline the main objective. It may sound cold. Not meant to be. Just matter of fact. More emphasis and support should be on the good that is happening. The hyper focus on this one incident is not worth the distraction.
